This study analyzes 19 documents related to weirs (洑) from the Majeon Yi clan's historical documents to examine the methods of private occupation and dispute cases concerning weirs in the Samcheon area of Jeonju during the 19th century. The weir sale document from 1829 represents the only existing case of weir transaction, revealing the discrepancy between public legal regulations regarding water resources (cheonjack) and private commercial practices. The first weir dispute in 1849 arose from conflicts between old and new weirs over the installation of water mills. At that time, the old weir was jointly owned and occupied by multiple clans, leading to regional-level litigation that expanded into a survival issue for the entire local community. The second weir dispute in 1889 serves as an important case demonstrating changes over approximately 40 years. The ownership and occupation structure of weirs shifted from joint ownership by multiple clans to concentration under the Majeon Yi clan, while the scope of disputes expanded beyond township boundaries into broad regional conflicts. Weir disputes were conducted through petition activities (jeongso) utilizing governmental administrative power, and the judgment criteria consistently maintained a tendency to prioritize the preemptive rights of existing weirs and the interests of the majority.

본 연구는 전주시 효자동 마전마을에 700여 년간 세거해 온 마전이씨 가문에 전승되는 19세기 보(洑) 관련 고문서 19점을 분석하여 조선후기 보의 존재 양태와 관련 분쟁 양상을 고찰하였다. 마전이씨 보 관련 문서는 양적 풍부성, 연대 명확성, 체계적 보관으로 사료적 가치가 높다. 분석 결과, 1829년 보 매매문서는 보가 명확한 거래 대상물이었음을 입증하며, 법제와 민간 관행 간의 괴리를 보여주는 유일무이한 사례이다. 1차 분쟁(1847~1850)은 마전이씨의 구보와 신보 간 이해 충돌로, 지역 공동체의 생존권 문제로 확대되었으며 선점권(先占權)이 핵심 법적 기준으로 작용했으나 그 실효성에는 한계가 있었다. 2차 분쟁(1888~1890)에서는 보 소유·점유 구조가 마전이씨로 집중되었고, 가뭄을 배경으로 신보의 축조 과정과 면 단위를 넘어선 분쟁 양상이 구체적으로 파악되었으며, 선점권 보호 원칙이 일관되게 적용됨을 확인되었다. 본 연구는 19세기 전주 삼천 유역의 보 소유 형태와 분쟁 양상을 미시사적 관점에서 규명하였다는 의의를 지닌다. 다만 특정 지역과 가문에 한정된 분석이므로, 향후 타 지역 사례와의 비교 연구를 통해 조선후기 수리시설을 둘러싼 사회적 갈등 구조와 해결 메커니즘에 대한 체계적 이해가 필요하다.
