This study analyzed previous research and regulations concerning educational materials in order to identify the legal issues surrounding the status of AI digital textbooks. Initially, educational materials included only printed books as of 1997, but later expanded to encompass audio recordings, videos, and electronic works. Although digital textbooks were classified as educational materials in the 2015 revised curriculum, they were not explicitly mentioned in the relevant regulations, prompting ongoing claims that their legal status needs to be secured. In 2023, the Ministry of Education revised the regulations on educational materials to define digital textbooks as learning support software that utilizes intelligent information technology. However, the National Assembly is attempting to amend the Elementary and Secondary Education Act to reclassify AI digital textbooks as "educational resources" - selected through the review of school management committees􀋁rather than as educational materials. Given that educational materials have evolved from printed books to various forms of electronic works, any legal revision on this matter should be carefully considered.

본 연구에서는 AI 디지털교과서의 법적 지위에 대한 쟁점을 파악하기 위하여 선행 연구 자료와 교과용도서에 관한 규정 등을 분석하였다. 교과용도서는 1997년 인쇄물인 도서만 포함하다가 이후에 음반, 영상, 전자저작물을 포함 하였다. 2015 개정 교육과정에서 디지털교과서는 교과용도서로 구분고시되었지만, 교과용도서에 관한 규정에 명시되 지 않아 법적 지위를 확보해야 한다는 주장이 끊임없이 제기되었다. 교육부는 2023년에 교과용도서를 개정하여 디 지털교과서를 지능정보화기술을 활용한 학습지원 소프트웨어로 명시하였다. 그러나 국회에서는 초중등교육법을 개정 하여 AI 디지털교과서를 '교과용도서’가 아닌 학교운영위원회 심의를 거쳐 선정하는 '교육자료’로 만들려 하고 있다. 그동안 교과용도서가 도서에서 다양한 형태의 전자저작물로 발전시켜 온 점을 고려할 때 이에 대한 법 개정은 신중 하게 검토되어야 할 것이다.
