Family is a basic organization which compose society. However, family is sectioning from increase of divorce rate recently. Cause of divorce is various kinds but one of them abuse by life partner’s mental disorder include. Researches about mental disorder person’s married life is proceeded vigorously but research about mental disorder that happen between marriage is not proceeded vigorously. Therefore, life partner’s mental disorder who is original and happens between marriage through divorce precedent examined about effect that get in married life. I used 4 examples among precedent of the Supreme Court from 1991 to 1997 for this study.Finally, with case, the study is to the discuss the social work intervention direction to reduce life partner’s mental disorder who happen between marriage.

가족은 사회를 구성하는 기본적인 조직체이다. 하지만 최근들어 이혼율의 증가로 인해 가족이 해체되어 가고 있다. 이혼의 원인은 여러 가지 있으나 그 중 하나가 배우자의 정신장애로 인한 학대도 포함되어 있다. 정신장애인의 결혼생활에 대한 연구는 활발하게 진행되고 있으나 혼인 중 발생하는 정신장애에 대한 연구는 활발하게 진행되지 못하고 있다.
따라서 본고에서는 이혼판례를 통해 혼인 중 발생하는 배우자의 정신장애가 결혼생활에 미치는 영향에 대해 살펴보았다. 본 연구를 위하여 1991년부터 1997년경까지 대법원의 판례 중 4갱의 사례를 사용하였다.
마지막을 사례를 바탕으로 혼인 중 발생하는 배우자의 정신장애를 경감시킬 수 있는 사회사업적 개입방안을 고찰하고자 하였다.
