This study explores the participation of transgender athletes in sports, focusing on issues of sex differences, discrimination, human rights, and fairness. Historically, women have been excluded from sports, but the 2024 Paris Olympics achieved numerical gender equality, addressing long-standing gender discrimination. However, advancements in medical technology have brought new controversy regarding the participation of transgender women in women's competitions. While the inclusion of transgender women reflects respect for human rights, it may be perceived as unfair to cisgender women. This presents a conflict between the protection of human rights and the principle of fairness, raising concerns about reverse discrimination. In the United States, legal disputes and social conflicts have emerged around this issue. Some propose separate categories for transgender athletes, but such measures may lead to further isolation. Rather than a matter of simple opposition or support, this issue involves complex ethical and legal considerations. This study aims to reexamine the topic through a balanced lens of human rights and fairness.

이 연구는 스포츠에서의 성 차이, 차별, 인권, 공정성을 통해 트랜스젠 더 선수의 경기 참여 문제를 고찰하였다. 고대부터 여성은 스포츠에서 배제되었으나, 2024년 파리올림픽은 50:50의 성비로 완전한 성 평등을 이루었다. 최근 의료기술 발달로 트랜스젠더 선수의 등장과 이들의 여성 스포츠 경기 참여허용이 새로운 이슈가 되었다. 왜냐하면 남성에서 여성 으로 성을 전환한 ‘트랜스젠더 여성’의 여성 경기 참여는 인권 존중 의 입장은 분명하지만 시스젠더 여성에게는 신체적 불공정이라는 문제 가 발생한다. 이는 인권보호와 공정성의 충돌로, 시스젠더에게는 역차별 이 발생한다. 이와 관련하여 미국에서 소송과 다툼이 생겼다. 이로써 트 랜스젠더 전용종목 신설의 논의도 있지만 이는 오히려 트랜스젠더의 고 립을 가져오는 우려가 있다. 트랜스젠더의 여성경기 참여는 인권을 보장 하지만 시스젠더에게는 공정하지 못한 측면이 있다. 트랜스젠더 선수의 스포츠 경기 참여는 단순한 찬반을 넘어 복합적인 인권(윤리․법)과 스포 츠의 공정성 문제이다. 이 연구는 이를 인권과 공정의 균형 속에서 재조 명하고자 하였다.
