As the role of government is emphasized, the tasks performed in the public sector are becoming more diverse and the tasks with high hazards and risks are increasing. The accident rates of national and local governments are also higher than the average for all industries, and efforts are needed to prevent occupational accidents in public administration workplaces. Article 3 of the OSH Act excludes public administration workplaces from the application of the provisions on safety and health management system (Chapter 2, Section 1 and Section 2 of the Act) and safety and health education (Chapter 3 of the Act), which has been criticized for weakening safety and health management in public administration workplaces. However, Article 3 of the Act takes into account the special nature of the work and the degree of hazard and risk, and is applied according to the main business of the workplace. It does not apply to workplaces that perform specific activities that are not public administration activities. In this study, we will review the criteria and issues for the application of the OSH Act to public administration workplaces, present interpretation criteria for the correct application of the OSH Act, and propose a direction of legal interpretation for effective OSH management at public administration workplaces.

국가의 역할이 강조됨에 따라 공공분야에서 수행하는 업무가 점차 다 양해지고 있으며 유해･위험이 높은 업무도 증가하고 있다. 국가 및 지방 자치단체의 사고재해율도 전산업 평균보다 높게 나타나 공공행정 사업 장의 산재예방을 위한 노력이 필요한 상황이다. 현행 ｢산업안전보건법｣은 공공행정 사업장에 대하여 안전보건관리체 제(법 제2장 제1절･제2절), 안전보건교육(법 제3장)에 관한 규정의 적용 을 제외하고 있어, 공공행정 사업장의 안전보건관리를 약화시킨다는 비 판이 제기되고 있다. 그러나 법 제3조의 단서 조항은 업무의 특수성과 유해･위험도를 고려한 것으로 사업장의 주된 업무에 따라 적용되며 특 정 사업을 수행하는 사업장까지 공공행정업이 적용되는 것은 아니다. 본 연구에서는 공공행정 사업장에 대한 ｢산업안전보건법｣적용 기준과 쟁점을 검토하여 ｢산업안전보건법｣의 올바른 적용에 관한 해석 기준을 제시하고, 공공행정 사업장의 실효적인 안전보건관리를 위한 법 해석 방 향을 제시해보았다.
