The United States has maintained a protectionist policy towards the shipbuilding industry, with laws prohibiting the construction and maintenance of U.S. Navy ships in foreign shipyards. The Barnes-Tollefson Amendment prohibits the construction of U.S. military vessels in foreign shipyards, and 10. U.S.C. §8680 restricts MRO for most U.S.-flagged ships from being performed in foreign shipyards. In recent years, however, the United States has emphasized the need to strengthen its maritime power in the face of the threat of losing ground to China, and is considering allowing shipbuilding and MRO in foreign shipyards due to the lack of infrastructure and manpower in domestic shipyards. The recently proposed ‘Ensuring Naval Readiness Act’ seeks to utilise allied shipyards, including those in South Korea, and the bill’s chances of passage seem higher than ever under Trump’s policy of reviving the shipbuilding industry in his second term. This paper examines the specific content of the legislation restricting entry into the US shipbuilding market and explores strategies for the Korean shipbuilding industry to effectively enter the US shipbuilding market, both at the government and private levels.

U.S.C. §8680은 미국을 모항으로 하는 대다수의 미 함정에 대한 MRO가 해외 조선소에서 이루어질 수 없도록 제한한다. 이러한 법령상의 제약은 한국 조선업계의 대미 함정 시장 진출에 큰 장벽으로 작용하고 있다. 그런데 미국은 최근 함정 수에서 중국에 뒤처지는 등으로 위기감이 고조됨에 따라 해상 전력 강화의 필요성을 강조하고 있으며, 자국 조선소의 인프라와 인력 부족 등으로 인해 해외 조선소에서의 함정 건조 및 MRO를 허용하는 방안을 검토하고 있다. 2025년 재발의된 ‘해군준비태세 보장법’은 한국을 포함한 동맹국 조선소를 활용하여 미군 함정을 건조하는 내용을 담고 있으며, 트럼프 2기의 조선업 부활 정책 기조에 따라 위 법안이 통과될 가능성은 그 어느 때보다 높다. 본 논문은 미 함정 시장의 진입을 제한하는 법령들의 구체적 내용 및 해군 준비태세 보장법의 내용을 검토하고, 한국 조선업계가 미 함정 시장에 효과적으로 진출하기 위한 전략을 정부 차원과 민간 차원으로 나누어 검토하였다.
