Despite the fact that two years have passed since the Human Trafficking Victims Protection Act was implemented to prevent human trafficking damage, which expanded the concept of human trafficking from ‘trafficking’ to ‘exploitation’ in accordance with international standards, the protection and support system for victims of human trafficking is facing problems such as difficulty in determining human trafficking, lack of reporting damage to human trafficking by ministries and support agencies related to human trafficking, blind spots in reporting and confirmation of damage to foreigners, inability to identify victims of trafficking in children, adolescents, and disabilities, and the absence of a local human trafficking victim rights protection agency. In order to establish a practical protection and support system for victims of human trafficking, ministries and support agencies in charge of crimes related to human trafficking should promote human trafficking reporting, prepare standards for determining human trafficking, compulsory confirmation and reporting of victims of human trafficking in children, adolescents, and disabilities, and resolving blind spots for foreign trafficking.

국제적 기준에 맞추어 인신매매에 대한 개념을 ‘매매’에서 ‘착취’로 확대한 인신매매등 피해를 예 방하기 위해 ｢인신매매등피해자보호법｣이 시행된 지 2년이 지났음에도 불구하고, 인신매매등피해 자에 대한 보호․지원체계는 인신매매등에 대한 판정의 어려움, 인신매매등 관련 범죄 소관 부처와 지원기관의 인신매매등 피해 신고 부족, 외국인 인신매매등 피해 신고와 확인의 사각지대, 아동․청 소년과 장애인 인신매매등피해자와 인신매매등범죄피해자 확인 불가, 지역인신매등피해자권익보호 기관 미설치 등과 같은 문제들에 직면한 상황이다. 인신매매등피해자에 대한 실질적 보호․지원체계 를 구축하기 위해서는 지역인신매매등피해자권익옹호기관 설치, 인신매매등 관련 범죄 소관 부처 와 지원기관들이 인신매매등 신고 활성화, 인신매매등 판정의 기준 마련, 아동․청소년과 장애인 인 신매매등피해자와 인신매매등범죄피해자 의무적 확인과 신고, 외국인 인신매매등 피해에 대한 사 각지대 해소 등과 같은 방안들을 순차적으로 추진해야 한다.
