While social enterprises have been contributing to solving social problems such as employment of the vulnerable and expansion of social services along with quantitative growth, their limitations are also revealed, such as their small size, concentration in job provision type, and dependence on government subsidies. Against this background, this paper examines the current legislation and legal discussions based on social enterprise financial support, draws implications for social enterprise financial support in Korea through a review of overseas cases such as the United States, the United Kingdom, and Spain, and suggests ways to improve social enterprise financial support. Since the enactment of the Social Enterprise Promotion Act, 22 amendments have been made to the Act and new laws have been proposed, but financial support for social enterprises is still centered on direct financial support, and an ecosystem for financing or an investment environment has not been created. As a result of reviewing overseas cases, focusing on the United States, the United Kingdom, and Spain, It found that, first, major countries have found limitations in financing social enterprises and are diversifying their financing methods from direct financial support such as government subsidies to solidarity funds and mixed funds with private capital matching; second, when focusing on vulnerable employment, they are providing more direct financial support than before to increase the sustainability of enterprises, while also providing regulatory provisions that allow enterprises to continue to pursue their social purpose; and third, connecting with the community is not only in the content of the business but also in the level of financing. Regarding the current status of social enterprises, they can be reclassified into three main types: Labor-integrated, Social problem-solving, and Cooperative or Solidarity social enterprises. The labor-integrated type needs to be supported by expanding direct financial support such as labor cost support, while the social problem-solving type needs to attract market and private investment and create a financial ecosystem to facilitate financing through the financial sector. In the case of cooperative or solidarity type, it is necessary to develop a legal system for the establishment and operation of a fund and the revitalization of financial cooperatives, taking into account the characteristics of the legal entity, and this should be done in conjunction with the discussion on the revision of the Basic Act on Cooperatives, rather than limited to the Social Enterprise Promotion Act.

그간 사회적기업은 양적 성장과 함께 취약계층 고용 및 사회서비스 확충 등 사회문제 해결에 기여해 온 동시에 영세성과 일자리제공형의 편중, 정부지원금 의존 등 그 한계점도 드러나고 있다. 이러한 배경에 서 본고는 사회적기업 재정지원의 근거가 되는 현행 법제와 법적 논의 들을 살피고 미국, 영국, 스페인 등 해외사례의 검토를 통해 우리나라 사회적기업 재정지원의 시사점을 도출하고, 사회적기업 재정지원 개선 방안을 제시하고자 한다. 「사회적기업육성법」제정 이래 사회적기업의 재정지원에 관한 개 정(안)은 22개이고, 신규 법(안)도 제기된 바 있으나, 사회적기업에 대한 재정지원은 여전히 직접 재정지원을 중심으로 이루어지고 자금조 달을 위한 생태계 조성이나 투자환경은 조성되지 않고 있다. 미국, 영국, 스페인을 중심으로 해외 사례를 검토한 결과, 첫째로 주요 국가들에서도 사회적기업의 자금조달 한계가 발견되었고 정부 보 조금 등 직접 재정지원에서 연대기금, 민간자본 매칭 혼합기금 등 자 금조달 방식을 다각화하고 있다는 점, 둘째로 취약계층 고용에 초점을 맞추는 경우 이전보다 전폭적인 직접 재정지원을 통해 기업의 지속가 능성을 높이면서 동시에 기업이 사회적 목적추구를 지속적으로 할 수 있는 규제조항도 마련하고 있다는 점, 셋째로 지역사회와 연계는 사업 의 내용 뿐 아니라 자금조달 차원에서 이루어지고 있다는 점을 확인하 였다. 우리나라 사회적기업은 그 내용을 보면 크게 노동통합형, 사회문제 해결형, 협동조합형 혹은 연대형 사회적기업의 세 가지로 재분류가 가 능하다. 노동통합형에 대해서는 인건비 지원 등의 직접 재정지원을 확 대하여서라도 이를 지원할 필요가 있는 반면에 사회문제해결형은 시장 및 민간의 투자를 유치하고 금융권을 통한 자금 조달이 용이할 수 있 도록 금융 생태계를 조성할 필요가 있다. 협동조합형 혹은 연대형의 경우 법인격의 특성을 감안하여 기금의 설립 및 운영, 금융협동조합의 활성화를 위한 법제를 정비할 필요가 있으며, 이는 「사회적기업법」 에 한정해 논의할 것이 아니라 「협동조합기본법」개정에 관한 논의로 연계하여 이루어져야 할 것이다.
