Cannabis is commonly known as a drug, but it also has medical applications, and its use is legally sanctioned in 68 countries. The development of hemp-based drugs has been particularly active globally since the creation of epilepsy treatments using hemp in 2018. These efforts have expanded patient treatment options and aimed to capture the high value-added market. In Korea, however, despite the revision of the 「Act on the Management of Narcotics」 in 2018 to permit medical hemp use, only authorized imports from overseas are allowed. This has stifled domestic development, preventing Korea from keeping pace with global trends. Meanwhile, social concerns and negative perceptions about hemp persist, exacerbated by high-profile cases of celebrities using cannabis. This study examined global regulatory trends in hemp and proposed ways to improve Korea's 「Act on the Management of Narcotics」to facilitate the medical use of non-psychoactive hemp. The research included an analysis of policy changes in the United States, Canada, Germany, France, and Japan regarding the legalization of medical cannabis and the promotion of the hemp industry. Notably, Japan, with a legal system similar to Korea's, revised its 「Cannabis Control Act」to the 「Act on the Regulation of Cannabis Cultivation」, distinguishing between cannabis cultivators and hemp research growers. This study suggests regulatory improvements based on these international examples to achieve full legalization of medical cannabis use in Korea.

대마는 마약의 일종으로 알려져 있으나, 의료용으로도 사용되고 있 으며 이를 법률로 보장하는 국가들은 68개나 된다. 2018년 대마 성 분을 이용한 뇌전증 치료제의 개발을 시작으로, 전 세계적으로도 대마 성분 의약품 개발이 매우 활발하여 환자의 치료기회를 확대하고 고부 가가치 시장을 선점하기 위해 노력하고 있다. 하지만, 우리나라는 의 료용 대마사용의 법적 근거가 되는 「마약류 관리에 관한 법률」이 2018년 개정된 이래 외형적으로는 의료용 대마사용을 허용하면서도 실제로는 해외에서 기허가된 제품의 수입만 가능할 뿐 국내 개발은 사 실상 불가능한 상황으로 세계적인 추세에는 발맞추지 못하고 있다. 또 한, 한편으로는 유명 연예인들이 대마초를 사용하다 적발되는 등 대마 에 대한 사회적 우려와 부정적 인식은 계속되고 있다. 본 연구는 이러한 사회적 논의를 기반으로 대마에 관한 글로벌 규제 동향을 조사하고, 향정작용이 없는 헴프(hemp)를 의료적으로 활용하 기 위한 「마약류 관리에 관한 법률」의 개선방안을 제시하였다. 이를 위해, 최근 의료용 대마사용의 합법화를 이루고 대마 관련 산업을 육 성시키고자 하는 미국과 캐나다, 독일, 프랑스, 일본의 국제적인 정책 변화를 살펴보았다. 특히, 우리나라 법률과 매우 유사한 법률 체계를 가진 일본이 「대마단속법」을 「대마초 재배규제에 관한 법률」로 개 정하며 대마재배자를 대마채취재배자와 대마연구재배자로 분류하는 등 의 우리가 참고할만한 점은 무엇인지 살펴보고, 우리나라가 의료용 대 마사용의 전면 합법화를 이룰 수 있는 규제적 개선방안을 제시하고자했다.
