Purpose: This study evaluates the need for mandatory membership in the Security Insurance Association to reduce liability gaps for security companies and guards, proposing solutions for enhancing the stability of private security and public safety. Method: The study analyzes cases of damage compensation by security companies and guards and identifies the legal basis and issues surrounding mandatory membership in the Security Insurance Association. Additionally, it compares and analyzes the bills related to the Security Insurance Association proposed in the 21st and 22nd National Assemblies to derive key issues and potential improvements. Result: While the current Security Industry Act regulates liability for damages, many cases still fail to provide sufficient compensation due to various limitations. The bills proposed in the National Assembly emphasize the necessity of mandatory membership and offer specific solutions, but they have not yet been enacted into law. Conclusion: Mandatory membership is crucial for improving the security industry’s credibility and ensuring faster compensation. A legal framework for such membership is necessary.

연구목적: 본 연구는 경비공제조합의 의무가입 필요성을 검토하고, 경비업체와 경비원의 손해배상 책 임 공백을 최소화할 방법을 모색한다. 현행 경비업법과 최근 발의된 법안을 분석하여, 공제조합 의무가 입이 민간 경비업의 안정성과 국민 안전 확보에 기여할 수 있는 방안을 제안한다. 연구방법: 경비업체와 경비원의 손해배상 사례를 분석하고, 경비공제조합 의무가입의 법적 근거와 문제점을 파악한다. 또한, 21대 및 22대 국회에서 발의된 경비공제조합 관련 법안을 비교·분석하여 주요 쟁점과 개선 방향을 도출 한다. 연구결과: 현재 경비업법은 손해배상 책임을 규정하고 있으나, 다양한 한계로 충분한 보상이 이 루어지지 않는 경우가 많다. 국회에서 발의된 법안들은 의무가입 필요성을 강조하며 구체적인 해결책 을 제시하고 있지만, 아직 입법화되지 않았다. 결론: 경비공제조합 의무가입은 경비업의 신뢰성과 국민 피해 구제를 강화하는 데 필수적이다. 법안 분석을 통해 의무가입이 경비업체의 재정적 안정성을 높이 고 피해 보상을 신속하게 할 수 있다는 점을 확인하였다. 이에 따라 법적 근거 마련이 필요하다.
