The type of PPP(public-private partnership) projects is promoted by Act on Public-Private Partnerships in Infrastructure or by Individual laws. In this paper, we compared two type of PPP projects and presented issues for each type. In PPP projects under the Act on Public-Private Partnerships in Infrastructure have the basic plan for PPP in infrastructure and guidelines, which are announced annually by the Ministry of Economy and Finance, are well established, so the project's implementation system is clear and consistent. PPP projects under individual laws do not have standardized guidelines at the government level, and the overall system of implementation of the project is inconsistent as the legal basis for each facility is implemented based on different individual laws. In PPP projects under individual laws, it is necessary to prepare a consistent implementation system and management plan by utilizing the project promotion method and procedure under the Act on PPP in infrastructure. It is important to establish an objective preliminary review system before the agreement, as it is difficult to terminate the project in the promotion stage after the concession agreement.

민간투자사업의 추진 방식은 ｢사회기반시설에 대한 민간투자법｣으로 추진하는 사업, 사업유형별로 사업추진 근거법이 되는 개별법령으로 추진하되 지방자치단체의 공유지 및 재산을 이용할 경우 ｢공유재산 및 물품관리법｣으로 추진하는 사업이 있다. 본 논문에서는 두가지 민간투자사업의 방식을 비교하고 각 방식별 쟁점을 제시하였다. 민간투자법에 따른 민간투자사업의 경우 기획재정부에서 매년 공고하는 ｢민간투자사업기본계획｣ 및 사업별 추진 지침이 잘 정비되어 있어 사업의 추진체계가 명확하고 일관성을 유지하고 있다. MRG제도를 둘러싼 여러 가지 문제점들을 기획재정부 차원에서 PIMAC의 지침개정을 통해 제도를 보완해+ 왔지만 여전히 높은 사용료나 민간사업자와의 분쟁 및 해지시지급 금으로 인한 자치단체의 재정적 부담이 이슈가 되고 있다. 이에 대한 대응은 개별 지방자치단체 뿐만 아니라 정부부처에 서도 관심을 두고 있다. 그러나 개별법에 따른 민간투자사업은 정부부처 차원의 표준화된 지침이 없고, 시설별 법적 근거가 각기 다른 개별법에 기초하여 추진됨에 따라 사업의 전반적인 추진체계에 일관성이 없다. 따라서 개별법에 따른 민간투자사업의 경우 민간투자법에 의한 사업추진방식과 절차를 활용하여 일관된 추진체계 및 관리방안을 마련할 필요가 있다. 다만 사업 추진 시에는 추진 절차가 미비한 개별법을 근거로 하고, 실시협약서는 정부의 보장이 상대적으로 많은 민간투자법을 준용하여 추진하게 되면 오히려 더 큰 문제가 발생할 수 있다는 점을 고려하여야 한다. 일단 협약 이후 추진단계에서는 사업을 해지하기가 어려우므로 협약체결에 앞서 객관적 사전검토 체계의 마련 등이 중요하다
