This paper proposes principles for seeking solutions to address the urgent issue of safeguarding the educational rights of immigrant children, based on an analysis of the current state of violations they experience. The study examines the challenges faced by immigrant children in educational settings and conducts an analysis of the current state of educational rights protection, alongside pertinent domestic and international policies. The current status of the right to education for children of immigrants has been analyzed by categorizing them into groups: children of parents from international marriages, children of immigrant workers, and children of North Korean defectors. The study examines how factors such as the parents'educational background, economic conditions, and social status affect the availability and quality of educational support. Policies related to the right to education for children of immigrants have been examined through cases from the UN, the UK, Germany, and South Korea. Drawing insights from the analysis, efforts were made to identify strategies and directions for policy improvement aimed at enhancing the effectiveness of support to reduce disparities in parental influence on the education of immigrant children. Additionally, the efforts made by the government, social institutions and organizations, and religious institutions to support the educational rights of migrant children were evaluated, and directions were identified to overcome the challenges that have emerged in supporting these rights. Based on the results obtained through the comprehensive analysis process, the study explored what and how Korean society, religious organizations, and institutions can contribute to enhancing the educational rights of migrant children. Furthermore, it discussed the implications of ensuring and supporting these educational rights for Korea's social development and the welfare mission of the church.

본고는 이주민 자녀가 경험하는 학습권 침해 관련 현황 분석을 기반으로 이주민 자녀 학습권 보장의 시급성 문제를 해결하기 위한 방안 모색의원리를 제안하였다. 이를 위해 이주민 자녀가 학교생활에서 겪는 문제가무엇인지를 심층적으로 다루되, 이주민 자녀의 학습권 보장 실태와 관련국내외 정책을 분석하였다. 이주민 자녀의 학습권 현황은 국제결혼 부모의아동, 이주민 노동자 부모의 아동, 탈북자부모의 아동 등으로 나누어 각 유형별 아동의 부모의 학력, 경제적 여건, 사회적 지위 등의 요건이 이주민자녀에 대한 학습 지원에 어떤 영향을 미치는지 등을 살폈다. 이주민 자녀 학습권 관련 정책은 UN, 영국과 독일, 그리고 한국의 사례를 고찰하였다. 이 과정에서 얻은 결과를 기반으로 이주민 자녀의 교육에 대한 부모의 영향력의 격차를 줄여 실효성을 높일 수 있는 지원과 정책개선 방향을 모색하였다. 이와 더불어 이주민 자녀 학습권 지원을 위한 정부, 사회기관 및 단체, 그리고 종교 기관이 그동안 추진해 온 노력을 평가하고, 노정된 문제를 극복할 수 있는 이주민 자녀 학습권 지원 방안의 방향을 찾았다. 제반 분석과정을 통해 얻은 결과에 따라 한국사회와 종교단체및 기관이 이주민 자녀 학습권 제고를 위해 무엇을, 어떻게 할 수 있는지를탐색하고, 더 나아가 이러한 학습권 보장 및 지원이 한국사회 발전과 교회의 복지선교적 차원의 함의가 무엇인지를 논의하였다.
