The purpose of this paper is to examines the main issues of the local council's personnel hearing system and to explore policy tasks to improve the system through case analysis of the Chungnam Provincial Council's personnel hearing system. The legal basis for personnel hearings of local councils was established by the revision of the Local Autonomy Act in March 2023 after the personnel hearing system based on the agreement with the executive branch for about ten years. Most metropolitan councils have established and operated personnel hearings based on ordinances since the law revision of 2023. It is difficult to say that there is any substantial change or progress compared with agreement-based personnel hearing system in terms of the legal status, function, and operation of local council confirmation hearings through the review of the Chungcheongnam-do Council's personnel hearings operation practices. Since the problems of the current local council's personnel hearing system are fundamentally due to national legislative limitations, legislative improvement measures need to be preceded. At the same time, in order to form a public consensus that drives legislative reform, innovation efforts by local councils to strengthen the function of personnel hearings are required despite the limitations of the existing legal system.

이 연구는 지방의회 인사청문회 제도의 주요 쟁점을 검토하고 충청남도의회 인사청문 회에 대한 사례 분석을 통하여 제도 개선을 위한 정책과제를 모색하고자 하였다. 집행부 와의 협약에 의한 인사청문제도 등을 거쳐 2023년 3월｢지방자치법｣개정에 의해 법적 근 거가 마련되고 현재 대부분의 광역의회에서는 조례에 기초한 인사청문회가 설치, 운영되 고 있다. 그러나 충남도의회 인사청문회의 운영 실태에 대한 검토를 통해 알 수 있듯이, 청문회 시행 및 결과, 청문 관계자 등에 대한 법적 구속력이 부여되지 않은 데다 청문 진 행 방식 등에 있어서도 협약에 의한 인사청문회 때와 실질적인 변화, 진전이 있다고는 하 기 어렵다. 인사청문회의 법적 지위나 기능, 운영 방식과 관련한 제도의 문제점은 근본적 으로 입법적 한계에 기인하는 것으로서 입법적 개선 조치가 선행될 필요가 있다. 아울러 입법 개혁을 추동하는 국민적 공감대 형성을 위해서는 기존 법제도의 한계 속에서도 인 사청문회의 기능을 강화하는 지방의회의 혁신 노력이 요청된다.
