The purpose of this paper is to empirically analyze the correlation between compliance with the laws of war and the outcomes of war. To this end, the study examines the U.S. stabilization operations during the 2003 Iraq War based on the principles of jus post bellum. Although the United States succeeded in toppling the Saddam Hussein regime within approximately two months of initiating the war, it failed to maintain domestic security and administrative reconstruction in Iraq during the early stages of stabilization operations due to a lack of troops and the absence of a civil-military cooperation system. Subsequently, with the increase in troop numbers and changes in stabilization strategies, the situation in Iraq rapidly stabilized. The primary cause of the initial deterioration in Iraq's domestic situation was the unilateral stabilization operations that did not adhere to the principles of jus post bellum. The success or failure of a war depends on securing support from both domestic and international communities, which is achievable through the demonstration of the war's legitimacy. Therefore, ensuring legitimacy through compliance with the laws of war during stabilization operations is essential, providing a crucial lesson for the successful execution of future stabilization operations on the Korean Peninsula.

본 논문의 목적은 전쟁 수행 과정에서 전쟁법의 준수가 전쟁의 승패에 관한 상호연관성을 실증적으로 분석하는 것이다. 이를 위해 2003년 이라크 전쟁에서 미군의 안정화작전 수행 과정을 전후법의 원칙에 근거하여 실증적으로 분석하였다. 미국은 전쟁 개시 약 2달 만에 사담 후세인 정권을 붕괴시켰으나, 안정화작전 초기 단계에서 병력 부족과 민·관 협력 체계 부재로 인해 이라크 국내의 치안 유지와 행정 재건에 실패했다. 이후 병력 증파와 안정화작 전 전략을 변경하면서 이라크 국내 상황은 빠르게 안정화된다. 미국이 초기 이라크 국내 상 황을 악화시킨 주요 원인은 전후법의 원칙을 준수하지 않은 일방적 안정화작전에 기인하는 것으로 나타났다. 전쟁의 승패는 국내 및 국제사회의 지지 확보에 달려있으며, 이는 전쟁의 정당성을 입증하는 과정에서 가능하다. 따라서 안정화작전 수행 시 전쟁법 준수를 통해 정 당성을 확보하는 것이 필수적이며, 이는 향후 한반도에서의 성공적인 안정화작전 수행을 위 한 중요한 교훈이 될 것이다.
