The hair dye market has been rapidly growing, driven by the 2016 revision of the “Cosmetics Act”, which reclassified hair dyes as functional cosmetics. With the reclassification of hair dyes from quasi-drugs to cosmetics, the standards for the use of ingredients used in hair dyes have become complex, integrating multiple regulations. The standards for the use of ingredients are crucial for determining the quality and safety of cosmetics, thus requiring clear and precise definitions. This study aims to analyze the issues that complicate the interpretation of the current standards for the use of hair dye substances and hair colorants, and to seek concrete solutions to address them. Through a review of laws, regulations and notices related to hair dyes, the study identified key issues: the lack of a legal basis for the positive list of hair dye substances, the dual-listing of hair dye components, unclear distinctions between hair dye substances and hair colorants, and ambiguity in the term “cosmetics for hair dyeing”. To address these issues and ensure the clarity of the standards for the use of ingredients, it is proposed to establish a legal basis for the positive list of hair dye ingredients, unify the list of hair dye ingredients, clearly distinguish between hair dye ingredients and hair colorants, and introduce a new term to define the scope of “cosmetics for hair dyeing”. It is anticipated that this study will contribute to minimizing issues related to regulatory interpretation in the industry and promoting the development of diverse hair dyes, thereby expanding consumer choice. Additionally, it is hoped that the continuous review and improvement of related regulations will be carried out, reflecting the market environment where various types of hair dyes are being developed.

최근 염모제 시장은 빠르게 성장하고 있으며, 이러한 성장의 배경에는 2016년「화장품법」개정에 따른 염모 제의 기능성화장품 전환이 있었다. 당시 염모제의 품목 관리 유형이 의약외품에서 화장품으로 전환됨에 따라, 염 모제에 사용되는 원료의 사용기준은 여러 법령을 통합하며 복잡한 형태를 띠게 되었다. 원료의 사용기준은 화장 품의 품질과 안전을 결정짓는 핵심 요소이므로 명확하게 규정될 필요가 있다. 본 연구에서는 현행 염모성분 및 염모용 색소의 사용기준 해석을 어렵게 하는 문제점을 분석하고, 이를 개선할 수 있는 구체적인 방안을 모색하 고자 한다. 염모제 관련 법령과 고시를 검토한 결과, 염모성분 파지티브 리스트에 대한 법적 근거 미비, 염모성 분 목록의 이원화, 염모성분과 염모용 색소의 구분 불명확성, 그리고 ‘염모용 화장품’ 용어의 모호성을 주요 문 제점으로 확인하였다. 이러한 문제를 해소하고 원료 사용기준의 명확성을 확보하기 위해 염모성분 파지티브 리 스트의 법적 근거 마련, 염모성분 목록의 일원화, 염모성분 및 염모용 색소의 명확한 구분, 그리고 염모용 화장 품의 범위를 나타내는 새로운 용어의 도입 필요성을 제안하였다. 향후 본 연구가 산업 현장에서 발생하는 규정 해석의 문제를 최소화하고, 다양한 염모제 개발을 촉진함으로써 소비자의 선택권을 넓히는 데 기여하기를 기대 한다. 또한, 다양한 유형의 염모제가 개발되고 있는 시장 환경을 반영하여 관련 법령의 지속적인 검토와 개선이 이루어지기를 바란다.
