Addressing climate change, as an inherently global issue, undoubtedly requires comprehensive international cooperation. However, the causes and impacts of climate change are intricately linked not only on a global scale but also at domestic and, more specifically, local levels. Therefore, developing effective strategies for climate adaptation and mitigation requires the active engagement of governments and local communities alike. In this context, the European Urban Charter III (2023) serves as a key example of how cities and local governments can bridge the gap between global commitments and practical implementation. The Charter underscores the pivotal role of cities in addressing climate-induced displacement, ensuring equitable access to resources, and empowering marginalized communities. By leveraging localized solutions and fostering public participation, cities enhance the legitimacy and sustainability of climate policies. The article concludes that the Charter provides a flexible, non-binding yet important framework for advancing sustainable development and human rights. While primarily a European initiative, the Charter offers a transferable model for integrating human rights principles into urban governance at the global level, making it a valuable tool for tackling global climate challenges in a manner that respects human dignity and equity.

기후 변화는 본질적으로 글로벌한 문제라는 점에서 이를 해결하기 위해 전적으로 국제적인 협력이 필요하다는 점에는 의심의 여지가 없다. 하지만 기후 변화의 원인과 영향은 글로벌한 차원뿐만 아니라 국내적, 특히 지역적 차원에서도 밀접한 연관이 있다. 기후변화의 적응과 완화를 위한 가장 효과적인 전략으로서 정부와 지방 및 지역 공동체의 적극적인 참여가 필요하다. 지방정부와 도시들은 기후 위기라는 과제에 대 응하기 위한 국가의 노력을 지원하고 특히 기후 변화와 관련된 인권에 기반한 국가의 의무를 이행하는 데 중요한 역할을 수행한다. 지방 정부는 실질적으로 인권 원칙에 부합하는 기후 정책을 설계하고 실행하는 실체로서, 특히 유럽 도시 헌장 III(European Urban Charter III)은 이와 같은 지방정부의 역할을 강조하고 있다. 동 헌장은 특히 현재 국제사회가 직면한 기후 위기를 인권적 관점에서 분석함에 중요한 의미를 지닌 다. 헌장은 의사결정 참여, 비차별 및 평등, 책임성과 법치, 투명성, 정보 접근성을 포함한 다양한 인권에 기반한 원칙을 제시하고 있다. 유럽 도시 헌장은 단순히 유럽 차원에만 국한된 이슈가 아닌 기후변화와 인권이라는 보다 글로벌한 이슈를 다루고 있다. 또한 일반적으로 “도시”의 역할이 국제법상 주요 논의대상은 아니지만, 도시 차원에서 이루어진 행위도 국가책임의 차원에서는 국가의 행위로 귀속이 된다는 점에 서 그 역할이 간과되어서는 안 된다. 유럽 도시 헌장 III는 지방 당국이 기후 변화에 따른 위기를 해결하기 위해 포괄적으로 대응할 것을 촉구하고, 의사결정 참여 과정부 터 기후 완화 및 적응 정책에 이르기까지 실행 가능한 구체적인 조치를 명시함으로써, 단지 유럽 국가뿐만 아니라 어느 국가에서든지 지방 차원에서 실질적으로 기후 관련 행동을 이행하는데 중요한 가이드라인을 제시하고 있는 국제적인 문서로서 중요한 의미가 있다.
