December 2024, South Korea. The unprecedented declaration of martial law and the impeachment of the president are calling for fundamental questions, reflection, and alternatives to the current democracy. This paper seeks to find a way to pursue the ideal of 'democracy' of self-governance of the demos in a modern way based on the post-democracy's awareness of the crisis and limitations of representative democracy. To this end, we will look at Plato's criticism of democracy and explore a new and powerful form of direct democracy based on the concept of politics and democracy by Rancière. In particular, through a reinterpretation and reevaluation of populism, it emphasizes the need for politics to expand the domain of politics that is virtually monopolized by political and economic elites and to increase citizen power. To this end, it proposes a democratic constitutionalism, arguing that the legislative and policy powers of the demos should be increased through the practical exercise of sovereign power. In addition, it argued that the democracy of the square that emerged in the wake of the impeachment of President Park Geun-hye should be the driving force behind the creation of a new constitution for social reform.

2024년 12월 악몽처럼 대한민국을 덮쳐온 계엄령 선포 및 대통령 탄핵사태는 현재의 민주주의에 대한 근본적인 문제제기와 성찰, 대안을 요구하고 있다. 본 논문은 대의정치의 위기와 한계라는 포스트민주주의의 문제의식에 기반하여 데모스의 자기통치라는 ‘democracy’의 이상을 현대적으로 추구할 수 있는 방안을 모색한다. 이를 위해 플라톤의 민주주의 비판을 살펴보고 랑시에르의 정치와 민주주의 개념에 기반하여 강력한 직접민주 주의를 모색한다. 특히, 포퓰리즘에 대한 재해석, 재평가를 통해 정치적, 경제적 엘리트들 이 사실상 독점하고 있는 정치의 영역을 확장하고 시민권력의 증대를 위한 새로운 정치가 필요함을 역설한다. 이를 위해 민주적 헌정주의를 제안하여 주권권력의 실질적인 행사를 통해 데모스 정치의 입법적, 정책적 권력을 증대시켜야 한다고 주장한다. 아울러 이번 탄 핵사태를 계기로 작동한 광장의 민주주의가 사회대개혁을 위한 새로운 헌법을 만드는 원 동력이 되어야 한다고 주장했다.
