Korea's individual debtor rehabilitation system has passed the 20th anniversary of its implementation, and its history has been characterized by a delicate balance between protecting personal rehabilitation creditors and curbing abuse of the system. Unlike Japanese courts, Korea has gradually established specialized rehabilitation courts to ensure the professionalism and efficiency of the rehabilitation process. This article analyzes the statistical data of personal rehabilitation cases handled by judges and rehabilitation commissioners to understand the current status of the process. Based on this, this paper analyzes the problems of the individual debtor rehabilitation system in the era of the Fourth Industrial Revolution, which is centered on artificial intelligence, and forecasts the future development of the individual debtor rehabilitation system by important issues.

한국 개인회생제도가 시행 20주년을 지났다. 그 20년 역사는 ‘개인회 생채권자 보호’와의 민감한 균형(제도 남용 억제)에 신경 쓰면서도, 큰 주류는 <개인회생채무자의 new start, 새 삶의 기회 확대의 역사>였다. 일본 재판소와는 달리, 한국은 개인회생절차의 전문성과 효율적 운영 을 위하여 회생전문법원을 점차 확대 설치해 왔다. 법관과 회생위원을 중심으로 수행되는 개인회생 사건 처리의 통계 데이터 분석을 통하여 그 절차 운영 현황을 알아본다. 이를 토대로 급변하는 인공지능 중심의 제4차 산업혁명시대에서 개 인회생절차 운영시스템의 문제점 개선과 중요 과제별 차세대 미래 발전 방향에 대하여 전망해 보았다.
