During the COVID-19 pandemic, the number of applications for individual rehabilitation procedures has increased along with a heightened sense of crisis due to personal excessive debt. The fact that an individual bears the accumulated heavy debt cannot be regarded as a matter of the individual only. This is likely to spread to problems of the family and society, which are communities. The individual rehabilitation systems are a legal debt adjustment system implemented in the court by using the income earned by the individual debtor in the future as the financial resources for repayment. The individual rehabilitation systems reduces the social and economic disadvantages of individual debtors due to the declaration of bankruptcy. The individual rehabilitation systems perform the functions of social security, the role of social safety net, the role of providing incentives to economic activities, and the function of leading to sustainable productive forces. In relation to the ex post legislative evaluation, this article examines the individual rehabilitation systems by first examining the existing prior public data. In addition, this article captures the opinions of experts who have directly experienced the current status of the individual rehabilitation systems and its problems in order to check and confirm the effectiveness of the individual rehabilitation systems and to grasp the actual system improvement. In addition, this article attempts to evaluate the effectiveness, legal relevance, systemicity, and equity of the individual rehabilitation systems.

코로나19 대유행기를 거치며 개인의 과중채무로 인한 위기의식의 고 조와 함께 개인회생절차 신청이 증가했다. 어느 한 개인이 누적된 과중 채무를 부담하고 있다는 것은 개인의 문제로만 치부할 수 없다. 이것은 공동체인 가정과 사회의 문제로 확산되기 쉽다. 개인회생제도는 개인채무자가 장래 얻게 되는 소득을 변제 재원으로 하여 법원 안에서 이루어지는 법률상 채무조정제도이다. 개인회생제도 는 개인채무자가 파산선고로 인하여 사회적 경제적 불이익을 받게 되는 것을 줄여준다. 개인회생제도는 사회보장의 기능, 사회안전망 역할, 경 제활동 유인을 제공하는 역할, 지속가능한 생산력으로 이어지도록 하는 기능 등을 한다. 이 글은 사후입법평가와 관련하여 먼저 기존 선행 공개데이터를 가지 고 사전 검토를 하여 개인회생제도를 진단해보고 있다. 또한 이 글은 개 인회생제도의 효과성을 점검 및 확인하며, 실질적인 제도 개선을 파악 하기 위하여 개인회생제도의 운영 현황과 문제점을 직접 경험하고 있는 전문가의 의견을 포착하고 있다. 그리고 이 글은 개인회생제도에 대하 여 실효성, 법적합성 및 체계성, 형평성 평가를 시도하고 있다.
