The Defense Acquisition Program Act was enacted in 2006 with the objective of enhancing the competitiveness of the defense industry. This objective was to be achieved by promoting transparency, expertise, and efficiency in the defense acquisition program, and by contributing to the advancement of a robust and capable military, as well as the development of the Korean national economic system. As a consequence of the Act, the Republic of Korea has become the fifth largest military power in the world and the ninth largest exporter of defense products in 2024. The objective is to become one of the top four defense contractors in the world. However, the necessity for the expeditious implementation of state-of-the-art science and technology in the military, based on the advancement of defense science and technology, has emerged due to the fact that the research and development of existing weapon systems has been concentrated on the methods of weapon system acquisition. This has resulted in the enactment of the Defense Science and Technology Innovation Promotion Act. However, confusion is emerging in the field of defense research and development regarding the conceptual understanding of contracts under the Defense Acquisition Program Act and agreements under the Defense Science and Technology Innovation Promotion Act. This study makes a clear distinction between the concepts of agreements and contracts, with the aim of facilitating a shift in paradigm from a defense industry that merely attempts to keep pace with technological developments to one that is at the forefront of innovation. In order to achieve this, it is necessary to conduct sophisticated and innovative research and development in line with the accelerated pace of technological advancement driven by the Fourth Industrial Revolution. In addition to this, the study puts forward policy suggestions for the revitalization of the defense R&D agreement system, with the goal of establishing a leading defense industry.

방위사업의 투명성·전문성 및 효율성을 증진하여 방위산업의 경쟁력을 강화하고 선진강군 육성과 국가경제 발전에 기여하 기 위해 2006년 방위사업법이 제정되었다. 이 법을 근간으로 우리나라는 2024년 세계군사력 5위와 방산수출 세계 9위의 성 과를 이룩하였다. 이제는 방산 수출 4대 강국으로 진입하기 위해 달려가고 있다. 그러나 기존의 무기체계연구개발은 무기체 계 획득을 위한 수단에 초점이 맞추어져 국방과학기술혁신을 기반으로 첨단 과학기술을 군에 빠르게 적용할 필요성이 제기되 어 국방과학기술혁신 촉진법이 제정되었다. 하지만 국방연구개발 현장에서는 방위사업법에 따른 계약과 국방과학기술혁신 촉 진법에 따른 협약의 개념적 이해에 대한 혼선이 발생하고 있다. 따라서 본 논문에서는 4차 산업혁명 등으로 기술발전 속도가 가속화됨에 따라 도전적이고 혁신적인 연구개발을 통해 기존의 추격형(Fast Follower) 방위산업에서 선도형(First Mover) 방위산업 생태계로 패러다임을 전환하기 위해 협약과 계약의 개념을 명확하게 구분하고 선도적인 방위산업 생태계 구축에 필 요한 국방연구개발 협약제도의 활성화 방안을 제시하고자 하였다.
