This study aims to examine cases of foreign workers' workplace conditions and legal protection issues in South Korea, as reported in international media, and to propose legal and policy improvements to address these issues. By focusing on industrial accident cases involving foreign workers residing in Korea, the study analyzes Korea's foreign worker policies, legal protection systems, and practical challenges, and suggests directions for improvement. In particular, the study emphasizes the need to strengthen education and practical management systems to ensure that foreign workers can safely exercise their right to stop work in hazardous situations. To support this, it proposes providing incentives to companies that prioritize occupational safety and health in industrial safety evaluations. Furthermore, the study highlights the necessity of expanding the scope of legal protection for foreign workers by including currently excluded visa categories and restructuring the legal framework to ensure equal protection of rights without discrimination. In conclusion, the study calls for enhanced legal protection systems for foreign workers, strengthened government oversight, and efforts to improve societal awareness. This research aims to provide policy implications for addressing the challenges faced by foreign workers in workplace conditions and legal protection.

본 연구는 해외 언론에 소개된 한국 사회에서 외국인 근로자가 직면하는 근무 환경 및 법적보호 문제 사례를 고찰하고, 이를 해결하기 위한 법적･정책적 개선 방안을 제시하는 데 목적을 둔다. 이를 위해 한국에 체류중인 외국인 근로자의 산업재해 사례를 중심으로, 한국의 외국인 근로자 정책, 법적 보호 체계, 현실적 인 문제점 등을 분석하고 개선 방향을 제시하고자 하였다. 특히, 외국인 근로자들이 안전하게 작업 중지권을 행사할 수 있도록 교육과 관리체계의 실질적 강화가 요구되며, 이를 지원하기 위해 산업안전 관련 평가 시스템에서 안전보건을 중시하는 기업에 대한 인센티브 제공 방안을 제안하였 다. 또한, 외국인 근로자 보호의 범위를 확대하여 현재 제외되는 특정 체류자격 근로자들에 대한 법적 보호를 강화하고, 차별 없는 권익 보장을 위해 법 체계를 재정비할 필요성을 강조하였다. 결론적으로는 외국인 근로자에 대한 법적 보호 체계를 강화하고, 정부의 관리 감독을 강화하며, 사회적 인식 개선 노력이 필요하다고 본다. 본 연구는 외국인 근로자의 근무 환경 및 법적보호 문제에 대한 정책적 시사점을 제공한다는 점에 서 의의를 찾고자 한다.
