After the enactment of the ｢Serious Accident Punishment Act｣, the two-year grace period for application has also passed. Now, it has been fully implemented at all workplaces with five or more employees. There was also a lot of concern about the full application of this law, such as the problem of the level of realistic safety levels at small and medium-sized workplaces. Industrial accidents are still occurring. Against this background, it would be timely to examine whether the Serious Accident Punishment Act can have normative power as a law governing the safety of workplaces. This article attempts to clarify that the ｢Serious Accident Punishment Act｣ is a criminal law dealing with dangerous societies that regulates the obligations of employer and CEO. Accordingly, focusing on the components of Article 4 of the Serious Accident Punishment Act – the obligation to secure safety and health – explains that the employer's obligation to secure safety and health is the responsibility to protect the safety, health, and life of workers. Furthermore, it shows that the employer and CEO are responsible for the social role of the employer and the manager, and suggests that the expansion of the constituent requirements will be necessary accordingly.

중대재해처벌법 제정 후 2년의 적용 유예기간도 도과하여 5인 이상 모든 사업장에 전면 시행되었다. 중소사업장의 현실적인 안전조치 수준 문 제 등 이 법률 전면 적용에 많은 우려도 있었다. 그러나 산업재해가 지 속적으로 발생하고 있고 이에 중대재해처벌법 전면 적용을 더는 미룰 수 없다는 입장이 우세하였다. 이러한 배경 속에서 중대재해처벌법이 산 업재해를 예방하고 근로자의 안전 및 건강을 보호하는 사업장 안전 규 율의 법률로서 규범력을 가질 수 있을 것인가에 대하여 살펴보는 것은 의의가 있다. 이 글은, 중대재해처벌법이 위험사회를 다루는 형법으로서 의 정합성을 가지고, 사업주 및 경영책임자등의 의무를 규정하는 법률임 을 밝힌다. 특히, 동 법률 제4조의 구성요건요소 – 안전 및 보건 확보 의무-의 내용을 중심적으로 살펴보아 사업주의 안전 및 보건 확보 ‘의무’는 근로자의 안전과 건강 및 생명을 보호하는 사업주 및 경영책임자 등의 ‘책임’임을 주장하고자 한다. 더 나아가, 이러한 책임은 사업주 및 경영책임자등의 사회적 역할에 대한 책임이라고 규정할 수 있으며, 이와 관련한 사항을 구체화하기 위해서는 제4조 요건의 확장이 필요함을 제시한다.
