This study aims to examine the labor shortages in specific occupational sectors in South Korea and to analyze the visa types and legal status of foreign workers from the perspective of civil rights. By utilizing government statistics and existing research, the study identifies occupations with severe labor shortages and subsequently reviews the visa types applicable to these sectors. The legal status of these visa categories, particularly in terms of civil rights, is then analyzed through relevant legal frameworks. The analysis reveals that there is a significant shortage of labor in low-skilled occupations such as restaurant service workers, truck drivers, and manufacturing laborers in South Korea. It was found that migrant workers with H-2 and F-4 visa statuses are widely employed in these sectors. Moreover, although the H-2 and F-4 visas offer relatively more flexible residency and workplace mobility, as well as allowances for family reunification compared to the E-9 and E-10 visas, they have not sufficiently addressed the labor shortages in these sectors. Therefore, the current immigration policy and visa systems require reevaluation and improvement.

본 연구는 한국의 노동력 부족 직종에 대한 실태를 파악하고, 외국인 노동자의 체류 자격과 법적 지위를 공민권 관점에서 분석하는 것을 목적으로 한다. 정부 지표와 기존 연구를 활용하여 노동력 부족이 심각한 직종을 식별하고, 이들 직종에서 필요한 체류 자격을 검토한 후, 해당 체류자격의 법적 지위(공민권)을 법령을 통해 분석하였다. 분석 결과, 국내에서는 식당 서비스원, 자동차 운전원, 제조 단순 종사자 등 저숙련 직종에서 노동력 공급이 특히 부족한 것으로 나타났고, 해당 직종에는 현행 체류자격 체계의 H-2와 F-4 체류 자격을 가진 이주 노동자가 관련 직종에서 광범위하게 근로할 수 있는 것으로 분석되었다. 한편 H-2와 F-4는 E-9, E-10, E-10 대비 비교적 유연한 체류와 사업장 이동이 가능하며, 가족 결합도 허용되는 등 더 나은 조건을 제공함에도 노동력 공급 부족 문제가 해결되지 않음을 고려할 때, 현재의 이주 정책과 체류 자격 제도는 개선이 필요하다고 평가할 수 할 수 있다.
