Illegal hospitals established by non-medical personnel threaten the health of the people, worsen the financial burden of the entire nation, and disrupt the medical ecosystem. This study examined the significance, types, and illegal features of illegal hospitals established by non-medical personnel. The Medical Service Act and the National Health Insurance Act, which can regulate illegal hospitals were reviewed. Issues and amendments that can compensate for the limitations of regulation were considered. The necessity of a partial revision of the National Health Insurance Corporation's special judicial police authority was considered. It also summarized an amendment to Article 57, Paragraph 2, Item 3 of the National Health Insurance Act to add Article 10 in addition to Article 33, Paragraph 8 of the Medical Service Act. In addition, it was proposed that "Article 33, Paragraph 2 of the Medical Service Act" stated in Article 47, Paragraph 2, Items 1 and 3 of the National Health Insurance Act should be amended as it does not comply with the Constitution of the Republic of Korea.

사무장병원은 국민의 건강을 위협하고 국민 전체의 재정부담을 악화 시키고 있으며, 의료생태계를 교란시킨다. 실질적 규제를 위한 법적 보완이 조속히 이루어져야 할 필요가 있다. 본 연구에서는 국민의 건 강에 위협을 가하는 사무장병원의 의의와 유형, 그리고 불법적 특징을 고찰하였다. 불법개설기관에 대한 해외입법사례를 비교 및 검토하였 다. 또한 사무장병원을 규제할 수 있는 의료법과 건강보험법을 검토하 고 규제의 한계를 보완할 수 있는 쟁점과 개정안을 검토하였다. 국민 건강보험공단의 특별사법경찰권 일부개정법률안의 필요성을 고찰하였 다. 또한 건강보험법 57조 제2항 제3호에 의료법 제33조 제8항 외에 제10항을 추가하는 개정안을 정리하였고, 추가로 건강보험법 47조의 2에 제1항, 제3항에 ‘의료법 제33조 제2항’에 관한 부분은 헌법에 합 치되지 아니하므로 보완할 것을 제안하였다.
