In this paper, the current status and problems of corporate internal investigations were analyzed, and the necessity of introducing a corporate detective system was considered. Internal investigations of companies play an important role for the sound management of companies, but as a result of analyzing the current situation, several problems are emerging. In other words, lack of professionalism, difficulty in active investigation of internal staff, selective audit of executives, and poor internal investigation are emerging as major problems. Under this recognition, looking at the actual state of internal investigation and use of detectives, it is confirmed that the roles and functions of detectives are required in various aspects, such as information collection and evidence acquisition, confidentiality and neutrality, industrial espionage response, and cooperation with legal procedures. . Therefore, this study can draw the conclusion that it is necessary to introduce a detective system in corporate internal investigations. In particular, it is highlighted that the introduction of a detective system is urgently needed in terms of confidentiality leaks and competitor industrial espionage investigations, cheating or unethical behavior investigations, utilization of professional investigation skills and experience, and securing objectivity through the participation of external experts. In addition, for the efficient operation of corporate internal investigations and the formation of a sound management culture, when introducing a detective system, cooperation with legal procedures must be properly conducted. It is expected that the introduction of such a corporate detective system will contribute to the sustainable development of companies and the securing of social trust.

본 논문에서는 기업 내부조사의 현황과 문제점을 분석하고, 기업탐 정제도 도입의 필요성을 고찰하였다. 기업 내부조사는 기업의 건전한 경영을 위해 중요한 역할을 수행하고 있으나, 현황 분석결과 여러 문 제점이 나타나고 있다. 즉 전문성 부족, 내부직원의 적극적 조사 어려움, 임원진에 대한 선택적 감사, 내부조사의 부실화등이 그 주요 문 제점으로 대두되고 있다. 이러한 인식하에 기업 내부조사와 탐정 활용실태를 살펴보면, 정보 수집 및 증거확보, 기밀유지와 중립성 확보, 산업스파이 대응, 법적 절차와의 협력 등 다양한 측면에서 탐정의 역할과 기능이 요구되는 것 으로 확인되고 있다. 따라서, 본 연구는 기업 내부조사에서 탐정제도 의 도입이 필요하다는 결론을 도출할 수 있다. 특히, 기밀 유출 및 경쟁사 산업스파이 조사, 부정행위나 비윤리적 행동 조사, 전문 조사 기술과 경험의 활용, 외부 전문가의 참여를 통 한 객관성 확보 등의 측면에서 탐정제도의 도입이 시급하다는 점이 부 각되고 있다. 또한 기업 내부조사의 효율적인 운영과 건전한 경영문화 형성을 위해 탐정제도의 도입시에는 법적 절차와의 협력이 적절히 이 루어져야 한다. 이러한 기업탐정제도의 도입을 통해 기업의 지속적인 발전과 사회적 신뢰 확보에 기여할 수 있을 것으로 기대한다.
