Declining birthrate is a major topic in Korean society. Although various policies have been implemented and are currently being planned, there have been few studies that analyze the declining birthrate in an integrated manner, focusing on the actual contents of the legislation. This study aims to examine Korea's fertility policy from a legal perspective. Specifically, based on the premise that the role of civil society based on collaborative governance and caring democracy is a key factor in overcoming the declining birthrate, this study examines the extent to which each of Korea's declining birthrate response laws reflects this concept. The results of the analysis showed that Korea's current low birthrate response legislation rarely reflects the concepts of collaborative governance and the role of civil society, such as community cooperation, communication, and the right to care. Based on the selected laws analyzed in this study, the policy implication is that the legal framework should be redesigned from a future-oriented perspective, taking into account the challenges of both overcoming the declining birthrate and adapting to a low-birthrate society.

현재 한국 사회의 주요 화두는 저출산이다. 관련하여 여러 정책이 진행된 바 있고 현재도 계획하고 있지만, 저출산 대응 법제가 포함하고 있는 실질적인 내 용들을 중심으로 통합적으로 저출산 정책을 분석하는 연구는 거의 진행된 바 없 다. 본 연구는 그동안 진행되어 온 한국의 저출산정책에 대하여 법제적 관점을 중심으로 고찰하고자 한다. 구체적으로는 협력적 거버넌스와 돌봄민주주의에 기 초한 시민사회의 역할이 저출산 극복에 있어 핵심적 요소가 된다는 전제 하에 각 저출산 대응 법률에 해당 개념이 어느 정도 반영되어 있는지 살펴보았다. 분 석 결과 현재 한국의 저출산 관련 대응 법제에는 협력적 거버넌스 및 시민사회 의 역할이라고 할 수 있는 공동체의 협력과 소통, 돌봄권 등의 개념이 거의 반 영되어 있지 않은 것으로 파악되었다. 본 연구에서 선정한 분석 대상 법률을 바 탕으로 할 때 저출산 극복과 저출산 사회에의 적응이라는 시대 과제를 동시에 고려하여 관련 법률 구조를 미래지향적 관점에서 재설계하여야 한다는 정책적 함의를 가진다.
