With the development of the market economy, corporate bankruptcy cases are increasing, and bankruptcy administrators play a crucial role in the bankruptcy process. In actual bankruptcy proceedings, bankruptcy administrators face multifaceted pressures and obstacles from various parties and institutions while performing their duties. In practice, the rights of bankruptcy administrators are often not well protected, making it difficult for them to fulfill their duties. This article first analyzes the legal status and responsibilities of bankruptcy administrators as well as the challenges they face in the bankruptcy process. Then, from the perspective of rights protection, it discusses the rights that bankruptcy administrators should enjoy during the performance of their duties, including the right to obtain information, investigation rights, property disposal rights, etc., and analyzes the obstacles these rights may encounter in actual operation. Through a systematic analysis and summary of the difficulties encountered by bankruptcy administrators in performing their duties, combined with the experience of local courts or bankruptcy administrator associations, this article attempts to put forward feasible suggestions for improving China's bankruptcy administrator's duty performance guarantee system.

중국은 최근 들어 시장경제의 발전으로 인하여 기업의 파산도 증가하 고 있다. 이에 파산관재인의 파산절차에서 그 중요성이 부각되고 있다. 실제 파산절차에서 파산관재인은 직무를 수행함에 있어 각 기관으로부터 다양한 어려움을 겪고 있다. 즉, 파산관재인은 파산업무 중 권리를 보호받지 못하는 경우가 많아 직무수행의 어려움이 많다. 본 연구에서 는 파산관재인의 법적지위와 책임을 현행법에 기초하여 검토하고, 파산 절차에서 직면하는 다양한 문제를 분석한다. 또 파산관재인의 권리보호 관점에서 정보취득권, 조사권, 재산처분권 등을 포함하여 파산관재인이 직무를 수행하는 과정에서 가지는 권리에 대해 논의한다. 또 이러한 권 리의 행사에 있어 실제 직면하는 장애요소를 분석한다. 이처럼 파산관 재인의 직무수행 과정에서 발생하는 여러 문제를 보다 체계적으로 분석은 지방법원이나 파산관재인협회의 기존 경험을 바탕으로 중국 파산관 재인의 직무수행 보장을 위한 제도개선에 좋은 자료를 제공할 것이라 본다.
