The ‘community correction’ in China is an alternative criminal execution and correctional system, which utilizes the social capital of the community to reduce the number of individuals sentenced to imprisonment, such as those sentenced to fixed-term imprisonment. Since 2003, the local community correction program in China has made progress through pilot implementations, expanding pilot programs, and nationwide implementation, effectively controlling the recidivism rate in the whole country within a range of 0.2%. This has led to positive results in the prevention of crime through judicial practice. Furthermore, on December 28, 2019, during the 15th session of the Standing Committee of the 13th National People's Congress, the “People's Republic of China Law on Community Correction” (hereinafter referred to as the ‘Community Correction Law’) was passed through a vote. By investigating the comprehensive implementation and development of local community correction in China, this analysis aims to evaluate the local achievements and identify existing problems in execution and verification. Recognizing persistent challenges, the analysis strives to identify the specific improvement measures for the system.

2019년 12월 28일, 제13기 전국인민대표대회 상무위원회 제15차 회의에서 표결을 통해 ｢중화 인민공화국 지역사회교정법｣이 통과되였다. 중국의 지역사회교정 제도는 지역의 사회자본을 이용하여 징역형등으로 인에 발생하는 수감 시설 수용 한계 부담을 줄이기 위한 대체적 형사집행 및 교정제도이다. 2003년부터 중국 지역사 회 교정 사업은 시범시행, 시범시행 확대, 전국시행의 단계를 거쳐 현재 전면적으로 추진하는 단계에 이르렀으며 전국 재범률을 0.2%의 범위내로 줄이는 데 기여하였다. 때문에 지역사회교정제도는 범죄 예방의 측면에서 범죄를 예방하는 데 좋은 효과를 거둔 사 법실천의 한 예로 꼽힌다. 이 논문을 통해 중국에서의 지역사회교정제도와 전면적 실시 및 발전 과정에서 얻은 현지 성과를 분석하고, 동시에 이 제도는 중국에서 현지화 발전 체계를 형성하는 단계에 불과하기에 보완해야 할 부분이 상당수 존재한다는 평가다. 이 논문에서는 중국의 지역사회교정제도를 소개하고 한국의 사회내처우제도의 일부와 민간 자본 및 사회단체의 참여 현황을 비교 분석하여 이 제도를 한층 더 개선하고 발전시킬 방안을 찾아보고자 한다.
