In the past decade, insurance fraud has increased in automobile insurance and long-term general insurance, especially in private health insurance. The implementation of the "Special Law for Insurance Fraud Prevention," which explicitly allows for enhanced penalties for high-value insurance fraud, was anticipated to lead to a significant reduction in occurrences of hard insurance fraud. However, there is a growing prevalence of organized insurance fraud. The lenient punishment for insurance fraud, compared to general fraud, persists due to an inadequate understanding of the severity of insurance fraud. As insurance fraud becomes increasingly sophisticated and organized, recent instances highlight the emergence of organized insurance fraud involving medical professionals. Establishing the illegality of such organized insurance fraud involving medical professionals poses challenges, requiring proactive legal and institutional measures for resolution. This study aims to clarify the concept of insurance fraud, assess the current landscape by focusing on diverse cases of organized insurance fraud involving medical professionals, and engage in a discussion on the gravity of insurance fraud. Furthermore, the study explores the connection of these phenomena with anomie, addressing societal and cultural issues and proposing improvements in the legal framework as potential solutions.

최근 10여년간 보험사기는 자동차보험과 장기손해보험을 중심으로 증가하였는데, 특히 실손의료보험 에서의 적발이 크게 증가하였다. 고액의 보험사기에 대해서는 가중처벌을 할 수 있도록 명시한 ｢보험사 기방지 특별법｣의 시행으로 보험사기 중에서도 경성 보험사기 발생이 많이 감소할 것으로 예상하였지만, 조직적인 보험사기가 더 증가하고 있다. 보험사기에 대한 처벌도 일반 사기에 비해 관대한데, 이는 보험 사기에 대한 안이한 인식이 개선되지 못하기 때문이다. 보험사기는 갈수록 지능화･조직화되는 경향이 있는데, 최근에는 전문의료인이 조직적으로 개입된 보험사 기가 큰 문제로 대두되고 있다. 전문의료인이 개입된 조직적인 보험사기에서는 불법성을 객관적으로 규명하기가 쉽지 않은데, 이의 개선을 위해서는 법률적･제도 측면에서 적극적인 대응이 필요할 것이다. 따라서 본 연구에서는 보험사기에 대한 개념을 정리하고, 최근 발생한 전문의료인이 조직적으로 개입 된 다양한 보험사기 사례를 중심으로 실태를 파악하여, 보험사기의 심각성을 논의해 보고자 한다. 또한 이러한 현상을 아노미 현상과 연계하여 사회문화적인 측면에서의 문제점과 대응 방안으로서 법체계의 개선 필요성을 논의해 본다.
