Vietnam's oldest existing law was enacted in the 15th century as the National Statute. This law was created by grafting the contemporary Ming code based on China's Tang code, and when Vietnam became independent after being subjugated to China for a long time, new orders and laws were needed to govern society at that time. China's Ming code at that time was effectively counted because it was appropriate for Vietnam to refer to the time and content. Most of the studies speculated that there were approximately several overall articles based on how many independent rules of the Ming code were counted, and it was difficult to find the contents of analysis or research on each article. Therefore, this paper tried to examine how the National Statute counted the independent legal regulations of the Ming code from a comparative legal point of view, and its background and impact. It was confirmed that the National Statute counted the Ming code around these articles in accordance with the atmosphere of the times to build more strongly on public affairs, society, and family order, and it was also found that it was linked to the strengthening of the monarchy. The National Statute of National Statutes selectively accepted the Ming code and tried to maintain its own customary law, and never accepted regulations that did not fit the Vietnamese situation. Through this, it was possible to see how much foreign laws, that is, Chinese laws, were accepted in the 15th century of the traditional Vietnamese period.

베트남의 현존하는 가장 오래된 법은 <국조형률>로써 15세기에 제정되었다. 이 법은 중국의 당률을 기반으로 동시대의 대명률을 접목하여 만들어졌는데, 베 트남이 오랫동안 중국에 예속되었다가 독립되며 당시 사회를 통치하기 위해 새 로운 질서와 법규가 필요하게 되었고 이에 당시 중국의 대명률은 베트남이 시기 나 내용적으로 참고하기에 적절하여 사실상 필연적으로 계수하였다. 다만, 대명 률의 독자적인 규율을 국조형률이 얼만큼 계수하였는지에 전체적인 조문만 대략 몇 개라고 추측하는 연구가 대부분이었고 조문별로 이를 분석하거나 연구한 내 용을 찾아보기 힘들었다. 따라서 본고에서는 이를 비교법적 관점에서 대명률의 독자적인 법 규정을 국조형률이 어떻게 계수하였는지와 그 배경과 영향을 살펴 보려 노력하였다. 그 결과 공무와 사회, 가족 질서를 보다 강력하게 구축하는 시 대 분위기에 맞게 이 조문들을 중심으로 국조형률이 대명률을 계수한 것을 확인 할 수 있었고, 왕권 강화와 연결되어 있다는 점도 알 수 있었다. 다만, 국조형률 은 대명률을 선택적으로 수용하면서 나름 관습법을 유지하려는 모습과 베트남 사정에 맞지 않는 규정들은 잘 갖추어진 법규라도 절대 수용하지 않는 모습도 보여주었다.
