The Presidents take part in the legislative process led by the Legislature through the Presidential Veto. President Yoon’s Administration in Korea has vetoed 9 bills including the Special Act for Itaewon Disaster so far during the period less than 2 years. This study aims at exploring the institutional reform measures of Presidential Veto and the desirable appearance of Presidential Veto in the legislative process of Korea through the comparative law study with the United States. To achieve the aim, this paper will overview the Presidential Veto power in Korean Constitution, and analyze its present condition and the problems. Finally, it will explore the institutional reform measures of Presidential Veto and the desirable appearance of Presidential Veto in the legislative process of Korea through the comparative law study with United States.

대통령은 법률안거부권 행사를 통해 국회의 입법과정에 간여한다. 그런데 윤석 열 정부가 출범한 후 채 2년이 되지 않았는데, 최근에 이태원 참사 특별법에 이르 기까지 이미 9개의 법률안에 대해 대통령의 거부권이 행사되었다. 본 연구는 이러 한 상황을 불러온 대통령의 법률안거부권에 대해 미국과의 비교법적 검토를 통해 제도적 개선방안을 살펴보고 우리 입법과정에서 대통령 법률안거부권 행사의 바람 직한 모습을 모색해보는 것을 연구의 목적으로 삼는다. 이를 위해 우선 우리의 법률안거부권 제도를 개관하고 현황과 문제점을 짚어본 뒤에, 미국과의 비교법적 검토를 통해 제도적 개선방안을 알아본 후, 결론을 통해 우리 입법과정에서 대통령 법률안거부권 행사의 바람직한 모습이 어떠해야 하는지 를 규명해본다.
