In recent years, with the continuous development of China’s economy and the gradual improvement of citizens’ awareness of risk prevention, China’s insurance industry has made leapfrog progress in terms of industry scale, number of institutions, innovation and development. However, at the same time, the problems faced by China’s insurance industry, such as hidden dangers in the industry and internal risks of institutions, are gradually exposed. In this context, if the risk of bankruptcy liquidation of insurance companies is ignored or the lack of effective disposal, it will inevitably lead to the expansion and spread of risks, which is not conducive to the overall development of the insurance industry, but also will have a negative impact on the national economy. At present, China has insufficient legal and institutional provisions on the bankruptcy liquidation of insurance companies, and the legal provisions of the insurance Law and the bankruptcy Law are not effectively linked, and there is a lack of specific legal provisions on the bankruptcy liquidation of insurance companies. When problems occur in the operation of an insurance company, it not only affects the credit of the company, but also affects the rights and interests of the policyholder. This brings systemic risks to the whole financial industry and affects social stability. From the main point of view of this paper, through the analysis of the conditions and characteristics of bankruptcy liquidation of Chinese insurance companies and the provisions of insurance protection fund, it is found that Chinese insurance companies have deficiencies in the legal system of bankruptcy liquidation, the implementing institution of bankruptcy liquidation and the operation mode of insurance protection fund. Based on this, the paper puts forward suggestions on the bankruptcy liquidation standards, supporting measures and systems of insurance companies, bankruptcy liquidation laws and regulations, clarifies the positioning and responsibilities of bankruptcy liquidation administrators and intermediaries, and improves the independent status and compensation standards of insurance protection funds, so as to promote the healthy development of China’s insurance market and maintain social stability and harmony. In view of the fact that China has not established a systematic legal mechanism for bankruptcy liquidation of insurance companies, there is no corresponding legal procedure for Chinese insurance companies to refer to in bankruptcy liquidation. In order to enable Chinese insurance companies to carry out bankruptcy liquidation smoothly, it is necessary to learn from the advanced experience of foreign insurance markets to perfect the legal mechanism of bankruptcy liquidation of Chinese insurance companies.

최근 몇 년 동안 중국 경제의 지속적인 발전과 국민의 위험예방의식이 점차 향상됨 에 따라 중국 보험업은 산업규모, 기구수량 및 혁신발전 측면에서 비약적인 발전을 이루었다. 그러나 이와 동시에 중국 보험업이 직면한 산업위험 및 기구내부위험과 같 은 문제점도 속출되었다. 이러한 맥락에서 보험회사의 파산 및 청산의 위험을 방치하 거나 효과적인 처리가 부족하면 필연적으로 위험이 확대되고 보험업의 전반적인 발전 에 도움이 되지 않을 뿐만 아니라 국가경제에도 부정적인 영향을 미칠 것이다. 현재 중국은 보험회사의 파산청산에 대한 법적, 제도적 규정이 충분하지 않고 보험 법과 파산법의 법적 조항이 효과적으로 연결되지 않고 있으며, 보험회사의 파산청산에 대한 구체적인 법적 규정이 부족하다. 보험회사의 운영에 문제가 발생하면 회사의 신 용에 영향을 미칠 뿐만 아니라 보험증권 보유자의 권익에 영향을 미친다. 이는 전체 금융업에 체계적인 위험을 초래하고 사회적 안정에 영향을 미친다. 본 논문의 주요 관점을 보면, 중국 보험회사의 파산 청산의 조건과 특성 및 보험기금 의 규정을 통하여 분석하고, 중국 보험회사가 파산 청산의 법적 시스템, 파산 청산의 시행기관 및 보험기금의 운영모델이 부족하다는 것이 발견되었다. 이를 바탕으로 보험 회사의 파산청산기준, 지원조치 및 제도, 파산청산법규에 대한 제안을 제시하고, 파산 청산관리자 및 중개기관의 위치와 책임을 명확히 하고, 보험기금의 독립적 지위 및 보상기준 개선 조치를 보완하며, 이로써 중국 보험시장의 건전한 발전을 촉진하고 사 회 안정과 조화를 유지한다. 현재 중국에 체계적인 보험회사 파산 청산에 대한 법적 메커니즘이 없다는 점을 감안할 때, 중국 보험회사는 파산 청산 시 참조되는 해당 법적 절차가 없다. 중국 보험회사의 원활한 파산 청산을 위해서는 외국 보험시장의 선진경 험을 바탕으로 중국 보험회사의 파산 청산의 법적 메커니즘을 개선해야 한다.
