This paper surveys the Guidelines on ‘Pilot Program with Functions Equivalent to the Personal Bankruptcy System’(for Trial Implementation)(‘与 个人破产制度功能相当’试点工作指引(试行))(2022)(hereafter the guidelines), which have been recently implemented as a preliminary step to personal bankruptcy law since 2022 by the Intermediate Court of Wuxi City, Jiangsu Province, China. As the current law of personal bankruptcy, China has only the Enterprise Bankruptcy Law(2006) and the Regulations of Shenzhen Special Economic Zone on Personal Bankruptcy (2020). As yet, the Regulations regarding personal bankruptcy exist only in local ordinances(only in Shenzhen) and the national law has not been enacted, so personal bankruptcy is not possible in other regions. Accordingly, several local courts at each level established regulations on personal debt clearance procedure as a preliminary step, and this article examines a more recent legislative example for procedure of personal debt clearance in the name of Guidelines on Pilot Program. In particular, we focused on the contents in general(II) and the contents of the provisions(III). The guidelines dealt with by this paper are comprised of 5 chapters and in total 67 articles. The contents of every chapter are as follows: general provisions(Chapter 1), petitions and acceptance(Chapter 2), trustees(Chapter 3), property of the debtor(Chapter 4), and procedure for clearance(Chapter 5). This paper deals with the guidelines chapter by chapter. In the contents in general(II), we survey first the legislative and scholastic efforts. Next, we deal with the composition, specific examples of application, and their significance, in turn. In the contents of provision(III), we also survey two types of procedures for clearance, liquidation procedure, and reconciliation procedure, along with petitions and acceptance in the court. The guidelines are a condensation of the court's relatively recent experience in personal debt clearance while referring to the current bankruptcy laws, regulations, and other existing court guidelines. The composition and provisions are similar to the current Enterprise Bankruptcy Act and the Regulations of Shenzhen and in this respect, in order to be integrated of the enterprise bankruptcy law and debt clearance procedures into a personal bankruptcy in the future. the guidelines gives us several implications in the composition and contents of bankruptcy procedures for a unified bankruptcy law.

이 글은 2021년 개인파산법 전단계로서 집행절차에 대하여 특수한 채 무정리절차를 중국 장수성(江苏省) 우시시(无锡市) 중급법원이 도입하 여 시행 중인 ‘개인파산제도기능에 상당한 시범지역 업무지침(시행)(‘与 个人破产制度功能相当’试点工作指引(试行))(2022년)(이하 “업무지침(시 행)”이라고 함)을 살펴본 것이다. 중국에서는 기업파산법만이 있고 아직 개인파산에 관한 규정이 지방조례로 있을 뿐이고 전국적인 법률로 마련 되지 아니하여 개인파산을 할 수 없어 그 사전단계로서 각급 법원이 개인 채무정리에 관한 규정을 마련한 것 중 최근의 입법례를 살펴본다. 업무지침(시행)은 모두 5장 67개 조문으로 되어 있다. 각각의 장은 총 칙(제1장), 신청과 접수(제2장), 관리인(제3장), 채무자 재산(제4장)과 정 리절차(제5장)이다. 이 중에서 정리절차는 다시 채권신고와 확인(제1절), 채권자회의(제2절), 청산방법의 채무정리(제3절), 화해방법의 채무정리 (제4절)와 면책과 복권(제5절)으로 세분하고 있다. 또한 마지막 조문(제 67조)에는 부칙에 해당하는 시행과 관한 조문이다. 이 글에서는 이러한 업무지침의 내용을 정확하게 파악하기 위하여 그 내용을 장별로 차례로 살펴보았다. 우선 일반론(II)에서는 현재까지 개인파산에 관한 중국에서의 그 동안의 입법의 노력을 살펴보고 업무지침(시행)의 편별체계와 구체적인 적 용례를 살펴보았다. 다음으로 업무지침(시행)의 구체적 내용(III)으로서 는 개인파산 유사절차 일반에 대하여 법원에서의 접수와 처리에 대한 일반론과 함께 정리절차로 청산절차와 화해절차의 2가지를 규정한다. 이러한 점에서 기업파산법이나 선천의 개인파산조례 등과 체계와 기본 적 조문내용이 유사하다. 이 지침은 현행 파산법령과 종래의 다른 법원 의 지침을 참조하면서 비교적 최근의 정리된 개인채무정리의 법원의 실 무의 경험을 응축한 것이다. 그 체계와 조문내용에서 현행법인 기업파 산법과 선천경제특구의 개인파산조례와 유사하고 이러한 점에서 향후 기업파산법의 절차와 개인파산으로서의 채무정리절차를 통합하여 통일 된 파산법을 위한 파산절차의 체계나 내용에서 여러 시사점을 준다.
