The title of this thesis is “The Analysis of Recent Precedents on the Rehabilitation and Bankruptcy - Focusing on Supreme Court precedents- ”. It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. I have reviewed about recent precedents on the rehabilitation and bankruptcy. For example, I have reviewed the amendments to the Judicial Justice Act relating to the scope of work of a judicial scrivener entrusted with regeneration and bankruptcy cases. I also have examined whether the right to divide property due to divorce can be the object of the subrogation right of a creditor and whether it belongs to the bankruptcy foundation.

이 논문의 제목은 “회생 및 파산과 관련 최근 판례 분석 – 대법원 판례를 중심으로-”라고 정하였다. 장래에 어떠한 문제가 발생할 것인지 를 현재의 시점에서 정확하게 예측할 수는 없지만, 그것이 사회질서를 규율하는 법 제도라고 한다면 불합리한 결과가 발생되지 않도록 그 위 험성을 최소화할 수 있는 방법들이 다양한 시각에 의하여 모색될 필요 가 있다. 이와 관련하여 본고에서는 특히 회생 및 파산제도와 관련한 최 근의 주요판결에 대하여 검토하였다. 예를 들어 회생과 파산사건을 위 임받은 법무사의 업무범위와 관련한 법무사법의 개정규정을 검토하였 고, 이혼으로 인한 재산분할청구권이 채권자대위권의 목적이 될 수 있 는지 여부 및 파산재단에 속하는지 여부에 대하여 검토하였다.
