Offenders with mental illnesses face challenges in achieving successful reentry into the community both during and after the probationary period. Unsuccessful reentry is linked to worsening mental health symptoms and an increased risk of recidivism. In response to this issue, this study aims to propose collaborative partnerships between the Ministry of Justice and community social resources to enhance the successful reentry of offenders with mental illnesses. A survey was conducted on 233 probation officers and 55 mental health specialists. The results indicate that while offering various social reentry supports (e.g., economic and medical assistance) to offenders with mental illnesses is beneficial, probation officers may encounter difficulties stemming from low offender motivation and a lack of collaboration with social welfare agencies. Based on these findings, the study suggests the implementation of a framework termed the “intensive integrated case management task force,” to be independently operated by the Ministry of Justice. This framework is anticipated to address challenges and contribute to successful community reentry, rehabilitation, recidivism prevention among offenders with mental illnesses, and overall community safety.

현재 정신질환을 가진 치료감호 가종료 대상자들은 치료의 연속성 뿐 아니라 지역 사회 내 성공적인 안착이 어려운 상황으로, 재범예방을 위해 다각적인 노력이 필요 하다. 이에 본 연구는 법무부가 치료감호 가종료 기간 동안 정신장애범죄인에 대한 집중적인 사례관리와 지역사회자원과의 연계를 더욱 원활하고 효과적으로 하는 방향 성 제시를 하고자 하였다. 치료감호 가종료 대상자의 재범 및 정신질환 재발을 관리 하고 예방하며 사회복귀를 지원하는 사회자원 연계방안에 중점을 두고 문헌고찰과 함께 보호관찰관 233명과 정신건강전문요원 55명을 대상으로 설문조사를 실시하였 다. 조사 결과, 치료감호 가종료 대상자들을 위한 경제, 의료 및 사회복귀지원이 있 지만, 대상자의 거부와 낮은 동기수준 및 서비스제공자의 안전 관련 이슈 등과 함께 지역사회기관과의 연계 및 법무부와의 협력 체계에서 어려움이 존재하는 것으로 나 타났고, 담당자의 전문성 강화가 중요한 요인으로 드러났다. 이에 보다 전문성이 강 화된 전담조직의 필요성에 기반하여, 법무부 주도형 “집중” 통합사례관리팀(Task Force)의 운영모델을 제안하였고, 이는 정신장애범죄인의 지역사회 안정적 적응, 재 활 및 재범 예방, 그리고 지역사회 안전을 보장하는 데 중요한 기여를 할 것으로 기대된다.
