On January 13, 2022, Local Autonomy Act was all revised. At this time, the newly established system of Experts Specializing in Policy Support was implemented with the purpose of strengthening the capabilities and expertise of local councils by supporting legislative activity of local council member. However, the absence of the concept of legislative activity may deviate from the work scope of policy support officer. This is because legislative activity of local council member is directly related to the work of policy support officer. In particular, political neutrality of policy support officer is achieved through the scope of support for legislative activity of local council member constituting local councils. Due to work contrary to the purpose of the introduction of the system, political neutrality in policy support officer may deviate and result in serious harm. political neutrality of policy support officer is directly related to the purpose of Local Autonomy Act, which is the balanced development of the provinces and democratic development of the Republic of Korea, and the welfare and happiness of local residents. The work in policy support officer is divided into competent affairs and general affairs. Looking at the autonomous laws, they are divided into 7 types based on the person in charge of the tasks in policy support officer. Depending on the subject of command, the chairman type, council member type, committee type, office organization type, mixed type A (local council member-secretariat), mixed type B (local council member-expert members), mixed type C (committee and expert memberssecretariat). Accordingly, the nature of legislative activity support, which is the task of policy support officer, also changes. Meanwhile, the similarities and differences between policy support officer, expert members and assistants of National Assembly were examined. Specifically, the characteristics of the legal basis, purpose, appointee, affiliation, number of persons, subject of command, rank, and political neutrality were identified. Through this, the purpose of this paper is to derive effective improvement plans and implications legislatively by demonstrating the scope of specific tasks of legislative activity support that meets the purpose of system of experts specializing in policy support.

지난 2022년 1월 13일 지방자치법이 전부 개정되었다. 이때 신설된 정책지원관 제도는 의원의 의정활동을 지원하여 지방의회의 역량과 전문성을 강화하기 위한 목적 으로 시행되었다. 하지만 지방의회에서 의정활동이 갖는 개념의 부재는 정책지원관의 업무 범위를 벗어날 수 있다. 정치활동과 의정활동은 구분되고, 의원의 의정활동은 정책지원관의 업무와 직결되기 때문이다. 특히 정책지원관의 정치적 중립성은 지방의 회를 구성하는 의원의 의정활동 지원의 범위를 통해 달성되는 것이다. 정책지원관의 정치적 중립성은 지방의 균형적 발전과 대한민국의 조화로운 민주적 발전을 주요 골자로 하는 지방자치법의 목적뿐만 아니라 지역주민의 복리 실현에 영향을 미친다. 그럼에도 불구하고 제도의 도입 취지에 반하는 업무지시로 인해 정책지원관의 헌법상 정치적 중립성이 일탈하거나 형해화되는 것은 논의할 쟁점이다. 정책지원관의 업무는 크게 소관사무와 일반사무로 구분된다. 자치법규를 살펴보면 정책지원관의 업무에 대한 지휘권자를 기준으로 7가지 형태로 나뉜다. 지휘의 주체에 따라 의장형, 의원형, 위원회형, 사무기구형, 혼합A형(의원-사무기구), 혼합B형(의원-전문위원), 혼합C형 (위원회 및 전문위원-사무기구형)으로 나타난다. 이에 따라 정책지원관의 업무인 의정 활동 지원의 성격도 달라진다. 한편, 지방의회 정책지원관과 소속위원회 전문위원 그리고 국회보좌직원의 공통점과 차이점을 살펴보았다. 구체적으로 법적 근거, 목적, 임명주체, 소속, 정수, 지휘 대상, 직급, 그리고 정치적 중립의무 부여에 대한 특징을 분석하였다. 이를 통해 정책지원관 제도의 도입취지에 부합한 의정활동 지원이 갖는 구체적인 업무의 범위를 논증하여 실효성 있는 입법적 개선방안과 시사점을 도출하는 것이 본고의 목적이다.
