The purpose of this study is to suggest legal and policy proposals so that more sportspeople can receive welfare benefits by analyzing the current status and problems of the Sportspeople Welfare Act. To this end, the current status and problems of the Act and legal and policy proposals were derived through the gathering and analysis of various research articles, and newspapers related to the welfare of athletes. The results are as follows. First, the scope of the Act was still exclusive, contrary to the main purpose of expanding the scope of Sportspeople. Second, dropping out athletes or unpopular sports athletes were not included in the scope of sportspeople. Third, there were no provisions for the establishment of a Sportspeople mutual aid association or Sportspeople welfare foundation under the Act, so it was expected that it would be difficult to carry out welfare projects in an integrated and stable manner. The legal and policy proposals for these research results are as follows. First, Enforcement Decree 2(1, 2) of the Act should be amended to further expand the scope of athletes. Second, the regulations should be corrected and supplemented so that welfare-disadvantaged groups such as dropping-out athletes and unpopular sports athletes can be sufficiently protected as sportspeople. Third, the establishment of the Sportspeople welfare foundation to implement various Sportspeople welfare projects including the Sportspeople mutual aid association project should be legally specified so that the foundation can manage welfare projects in an integrated manner. Lastly, sufficient public opinion formation and social consensus should be drawn so that the sportspeople welfare foundation can be placed under the Korea Sports Promotion Foundation and the funds for the initial operation of the foundation can be covered through government support or the National Sports Promotion Fund.

본 연구는 ｢체육인 복지법｣의 현황과 문제점을 분석하여 더 많은 체육인이 복지혜택을 누릴 수 있도록 법률적⋅정 책적 제언을 제시하는 데 그 목적이 있었다. 이를 위해 체육인 복지 관련 각종 연구물, 기사 등의 수집 및 분석을 통해 ｢체육인 복지법｣의 현황과 문제점, 이에 따른 법률적⋅정책적 제언을 도출하였으며, 그 결과는 다음과 같다. 첫째, ｢체육 인 복지법｣의 체육인 범위 확대라는 본 취지에 맞지 않게 여전히 그 대상 선수 범위가 배타적이었으며, 둘째, 중도탈락선수 나 비인기종목 선수는 체육인의 범위에 포함되지 못하였다. 셋째, ｢체육인 복지법｣상 체육인 공제회나 체육인 복지재단의 설립 규정이 없어 복지사업을 통합적⋅안정적으로 수행하는 데 어려움이 예상되었다. 이러한 연구 결과에 대한 법률적⋅ 정책적 제언으로 첫째, ｢체육인 복지법｣ 시행령 제2조제1항과 제2항을 수정하여 체육인의 범위를 더욱 확대해야 한다. 둘째, 중도탈락선수, 비인기종목 선수 등의 복지 소외대상들 또한 체육인으로서 충분히 보호받을 수 있도록 규정을 정비⋅ 보완해야 할 것이다. 셋째, 다양한 체육인 복지사업을 시행할 체육인 복지재단 설립과 체육인 공제사업을 포함한 사업내용 을 법적으로 명시하여 재단이 복지사업을 통합적으로 관리할 수 있도록 해야 할 것이다. 마지막으로 재단을 국민체육진흥 공단 산하로 배치하고 초기 재단운영의 재원을 정부 지원이나 국민체육진흥기금을 통해 충당할 수 있도록 충분한 여론 형성과 사회적 합의가 도출되어야 할 것이다.
