Social disasters that repeat every year have brought many changes to our society. For the purpose of preventing the repetition of disasters, special laws with tougher punishments were enacted and revised, and this tendency of strict punishment led to the enactment of the 『Serious Disaster Punishment Act』. However, unlike these criminal legal responses, analysis or evaluation of this is not sufficient. Therefore, this study aimed to examine the reality of enactment and revision of numerous laws to strengthen punishment and analyze the problems. As a result of the analysis through the regulation forms and statutory punishments of the special laws, it was found that the special laws were managed based on unclear standards because there was no integrated management department and the competent ministries were scattered. As a result, it was found that laws that should be applied are not applied, laws that do not need to be applied are applied overlappingly, and errors are occurring in legislation and legal application, but are not corrected. To prevent these confusions, we can refer to the legislative precedents of Germany and China, which stipulate social disaster punishment regulations within their penal codes. And now that interest is increasing due to the enactment of 『Serious Disaster Punishment Act』it is expected that many people's opinions will be gathered and used as a driving force to improve.

해마다 반복되는 사회재난의 악몽은 우리 사회에 많은 변화를 가져 왔다. 사회재난이 발생한 이후 재난의 반복을 막아야 한다는 이유로 처벌을 강화한 특별 법률을 제·개정했고, 이러한 엄벌주의 경향은 『중대재해 처벌 등에 관한 법률』제정까지 나아갔다. 그러나 이런 형사법적 대응과는 달리 이에 대한 분석 또는 평가는 충분하지 않다. 따라서 이 연구는 처벌 강화를 위해 수많은 법률이 제·개정되는 현실 을 살펴보고 그 문제점을 분석하고자 했다. 특별법의 규정 형식과 법정형을 통해 분석한 결과, 통합 관리부서가 없이 소관부처가 산재되어 불분명한 기준으로 특별법이 관리되고 있다 는 점을 알 수 있었고, 그 결과 적용되어야 할 법률이 적용되지 않거 나, 적용될 필요가 없는 법률이 중첩적으로 적용될 뿐만 아니라, 입법 과 법적용에서 오류가 발생되고 있으나 수정되지 않는 점을 살펴볼 수 있었다. 이러한 혼란을 방지하기 위해 우리는 사회재난 처벌 규정을 형법전 내에 규정하고 있는 독일과 중국의 입법례를 참고할 수 있을 것이다. 그리고 『중대재해 처벌 등에 관한 법률』제정에 따라 관심이 증가하 는 현재, 많은 사람들의 의견을 모아 현실을 개선하는 원동력으로 삼 을 수 있을 것이라 기대한다.
