Information and communication technology (ICT) is developing in leaps and bounds in our society and is having an impact on the depths of our daily lives. However, it is difficult to find legal consideration in Korea for the protection of the socially disadvantaged. In particular, it is more difficult to find laws in the legal system or rules to protect elder consumers for ICT-Field in the rapidly aging reality. The regulations that can strengthen the accessibility of Small or Medium Enterprises(SMEs) with regard to so-called kiosks or mobile communication points within our legislation include the 'Act on the Prohibition of Disadvantaging Persons with Disabilities' and 'Act on Intelligent Informatization' . However, while both of the above laws impose obligations on public institutions, it is regrettable that they are only recommended or encouraged for barrier-free policies for general private companies. This is despite the fact that the majority of consumers have far more experiences in their daily lives with SMEs than public institutions. Both accessibility regulations were revised for disabled people in 2021 and thus formed a basis for the current accessibility policy. However, elderly consumers are not subject to both regulations. In the case of Germany, barrier-free regulations include both the disabled and the elderly, but in Korea, regulations for the protection of elderly consumers cannot be found because they are regulated separately. An inclusive society in which everyone leads a self-determined life is a common goal shared by many in the world. In order to achieve such a society the most important approach is to focus on step-by-step accessibility for all people, regardless of disability or age. The Accessibility Act promotes equal and non-discriminatory participation in products and services for people with disabilities, the elderly or other limitations. In Germany, the EU guidelines for accessibility were implemented and carried out through the BFSG. The German Accessibility Act (BFSG) to harmonize EU regulations. It contributes to the activation of the internal European market for SMEs. This trend in Europe and Germany suggests that our legal system should protect the accessibility of the socially underprivileged by law and deal with it in detail and care. The laws of our legal system need to be reviewed, while looking at the implementation and outcomes of those in Europe and Germany, to ensure they not only extend to just disabled or just elderly consumers, but justly to both Therefore, It is especially important in a rapidly aging society to consider barrier-free policies for SMEs as well as public institutions so that the information rights and access rights of elderly consumers are not excluded.

점차 우리 사회의 정보통신기술은 비약적으로 발전하고 있으며, 우리 일상 깊숙한 곳에서 작용되고 있다. 하지만, 정작 보호해야 할 사회적약자에 대한 법적 배려는 찾아 보기 어렵다. 특히, 급속도로 고령화되고 있는 현실에서 정보통신기술에 대한 노인소 비자 보호법제는 찾아보기 어렵다. 우리 법제 내에서 무인정보단말기 또는 이동통신단말장치 등과 관련하여 중소기업 에 배리어프리정책을 강화할 수 있는 규정으로는 장애인차별금지법과 지능정보화기본 법이 있다. 하지만 소비자가 일상에서 가장 먼저 경험하게 되는 중소기업에 대한 의무 규정이 없다는 아쉬움이 있다. 나아가 장애인에 대한 베리어프리 규정이 2021년 개정 됨으로써 베리어프리정책의 근간을 이루기는 하였으나, 고령의 노인소비자는 적용대 상이 아니라는 점 역시 간과할 수 없는 부분이다. 독일 역시 배리어프리강화법(BFSG)을 제정하기 이전에는 우리 장애인차별금지법과 같이 장애인평등법(BGG)에 따라 그 행위주체가 공공기관으로 한정되어 있었다. 하지 만 유엔의 장애인권리협약에 따라 장애인에 대한 물리적 환경, 교통, 정보통신 기술 및 시스템을 포함한 정보통신에서 동등한 접근권을 보장하고, 그러한 접근권 강화를 위한 구체적이고 실현 가능한 법제도를 확립하기 위해 유럽의회는 배리어프리에 관한 권고규정(Richtlinie (EU) 2019/882)에 합의함에 따라, 2021년 독일의 배리어프리강화 법이 제정되었으며, 민간도 공공기관과 동일한 규율의 적용대상이 되었다는 점에서 우 리 법제에 주는 시사점이 상당하다. 나아가 이러한 유럽 및 독일의 법제는 장애 관련 법률이 장애인뿐만 아니라, ‘기능적 제한이 있는 사람(Menschen mit funktionellen Einschränkungen)’ 즉, 노인, 임산부까지도 적용범위를 확대하여 해석하고 있다는 점 도 우리 법제에서 주목할 만한 점이다. 그러므로 이미 초고령사회를 겪고 있는 유럽과 독일의 이러한 베리어프리정책은 급 속하게 고령화되고 있는 우리 사회에서 공공과 민간에 대하여, 장애인은 물론 노인소 비자의 정보권과 접근권이 배제되지 않도록 입법적 노력이 필요한 시점이다.
