The Data Safe Zone is a system established based on the ｢Basic Act on Promotion of the Data Industry and Utilization｣, and is a platform that supports the safe analysis and use of various data, including unopened data, or It refers to a system that allows anyone to use unopened data of public institutions and private companies that are not normally easily accessible free of charge in a safe analysis environment and analysis space. This data safe zone system provides an environment in which various data can be analyzed and used for start-ups or small and medium-sized enterprises (SMEs), which have relatively difficulty in securing various data compared to large companies, so that If a company utilizes the analysis results for marketing, customized product development, etc., it is expected that the purpose can be achieved more effectively. ｢Basic Act on Data Industry Promotion and Utilization Promotion｣ and its enforcement decree stipulate matters related to designation and operation of data safe zones and establishment and implementation of technical, physical and managerial security measures for data safe zones. The Ministry of Science and ICT has published guidelines on two types of data safe zones and is implementing the data safe zone designation system in earnest. The data safety zone system is still in its early stages of implementation, so it is necessary to find out the problems of the current legislative system in order to establish a stable data safety zone system and derive legal and institutional improvements at the current stage. To this end, this paper closely analyzed the main contents of the Data Safety Zone in the Basic Act on the Promotion and Use of the Data Industry and the Enforcement Decree of the same Act and the Ministry of Science and ICT's guidelines on the Data Safety Zone. In addition, Based on the analysis results, the main problems of the current legal system regarding the data security zone system and the needs for supplementation and improvement were identified, and a plan to improve the current data security zone-related legislative system was proposed to solve this problem.

데이터안심구역은 ｢데이터 산업진흥 및 이용촉진에 관한 기본법｣에 근거하여 마련 된 제도로서 미개방데이터 등을 포함한 다양한 데이터를 안전하게 분석·활용할 수 있도록 지원해주는 플랫폼이자 평소에 쉽게 접근할 수 없는 공공기관 및 민간기업의 미개방데이터를 안전한 분석환경 및 분석공간에서 누구든지 무료로 활용할 수 있도록 지원해주는 제도를 말한다. 이러한 데이터안심구역 제도는 대기업에 비해 상대적으로 다양한 데이터의 확보가 어려운 신생기업 또는 중소기업에게 다양한 데이터를 분석· 활용할 수 있는 환경을 제공함으로써, 만일 기업이 그 분석결과를 마케팅, 맞춤형 제 품 개발 등을 위해 활용할 경우 그 목적을 보다 효과적으로 달성할 수 있을 것으로 기대된다. ｢데이터 산업진흥 및 이용촉진에 관한 기본법｣ 및 같은 법 시행령에서는 데이터안 심구역의 지정 및 운영 등과 기술적·물리적·관리적 보안대책의 수립 및 시행에 관한 사항을 규정하고 있으며, 이를 근거로 과학기술정보통신부는 2종의 데이터안심구역에 관한 지침을 제정하여 데이터안심구역 제도를 본격적으로 시행하고 있다. 데이터안심 구역 제도는 아직 시행 초기단계에 있어 향후 추진과정을 좀 더 지켜볼 필요가 있지만, 안정적인 데이터안심구역 제도의 확립을 위해서는 현행 관련 입법체계상 문제점 등이 무엇인지 파악하여 현재 단계에서의 법제도적 개선 필요사항들을 도출할 필요가 있다. 이를 위하여 본 논문에서는 ｢데이터 산업진흥 및 이용촉진에 관한 기본법｣ 및 같은 법 시행령과 과학기술정보통신부의 데이터안심구역 관련 지침에서의 데이터안심구역 에 관한 주요 내용들을 면밀히 분석하였다. 더 나아가, 그 분석결과를 바탕으로 데이터 안심구역 제도에 관한 현행 법체계의 주요 문제점과 보완 및 개선 필요사항이 무엇인 지 파악하였고, 이를 해결하기 위한 현행 데이터안심구역 관련 입법체계의 개선방안을 제시하였다.
