String sales, in which resale is carried out several times in transit, mainly occur in commodity sales, and private associations such as GAFTA provide standard contracts to respond to commodity sales accompanied by string sales based on long-accumulated experiences. It is leading intrnational commodities trade. In Incoterms 2010, the procurement were inserted in the FAS, FOB, CFR, and CIF conditions, so that the seller can complete the seller's delivery obligation by delivering the goods already shipped to the buyer, and Incoterms 2020 , the scope of procurement was expanded to respond to all modes of transportation by inserting the procurement in all trade terms except for EXW conditions. In this study, the major revisions of Incoterms 2020 were reviewed to derive user's considerations for utilization, and the applicability of Incoterms 2020 to string sales was reviewed by considering trading practices of commodity sales. The commodity sales accompanied by string sales is led by standard contracts devised by international commodity associations such as GAFTA and FOSFA, and these standard contracts include quantity, quality, payment, arbitration, etc. Matters throughout the sales contract are stipulated, provision of appropriation and shipping documents in relation to string sales, and arbitration clauses for string sales are stipulated so that complex transactions of string sales can be easily concluded and fulfilled. In addition, these standard contracts exclude the application of these standard contracts to avoid conflicts between long-accumulated practices, British laws and customs as governing laws, and CISG, Incoterms. On the other hand, The Incoterms 2020 simply states that the seller’s delivery obligation can be completed by procurement. The current trading of commodity sales is led by these associations, and unless the standard contract excludes the application of Incoterms, there is a limit to the application of Incoterms in string sales of commodity. Therefore, it will be necessary for the International Chamber of Commerce to develop its own standard contract model for string sale of commodities, rather than seeking the application of Incoterms by these associations.

운송과정 중에 수 차례 전매가 이루어지는 연속매매는 주로 일차산품 매매에서 발생하며, GAFTA와 같은 민간협회에서 오랜 기간 축적된 경험을 바탕으로 연속매매가 수반되는 일차산품의 매매에 대응하기 위한 표준계약서를 제공하여 일차산품 거래를 주도하고 있다. 인코텀즈에 서는 2010년 개정에서 해상운송 전용조건인 FAS, FOB, CFR, CIF 조건에 후속 매도인이 이미 선적된 물품을 매수인에게 인도함으로서 매도 인의 인도의무를 완료할 있도록 조달규정을 삽입하였고, 2020년 개정에서 EXW 조건을 제외한 모든 정형거래조건에서 조달규정을 삽입하여 모든 운송수단에서 일차산품의 매매에 대응할 수 있도록 조달규정의 범위를 확장하였다. 본 연구에서는 인코텀즈 2020의 주요 개정사항을 고 찰하여 사용자의 활용상의 유의점을 도출하는 한편, 일차산품의 매매관행을 고찰하여 인코텀즈 2020의 연속매매 적용가능성을 검토하였다. 연속매매가 수반되는 일차산품의 매매는 GAFTA, FOSFA와 같은 국제일차산품협회에 의해 고안된 표준계약서에 의해 주도되고 있으며, 이 러한 표준계약서에는 거래물품의 종류와 거래 조건에 따라 수량, 품질, 결제, 중재 등 매매계약 전반에 걸친 사항이 규정되어 있고 연속매매와 관련하여 충당(appropriation)과 선적서류의 제공 그리고 연속매매를 위한 중재조항 등을 규정하여 복잡한 일차산품의 매매를 용이하게 체결 및 이행할 수 있도록 하고 있다. 또한 이들 표준계약서에서는 오랜 기간 축적된 관행과 준거법으로서의 영국의 법률과 관습과 CISG 및 인코텀 즈와 같은 국제조약과 규칙간의 상충을 피하기 위해 이의 적용을 배제하고 있다. 반면에 인코텀즈 2020에서는 매도인의 인도의무에서 단순히 조달에 의해 인도의무를 완료할 수 있다고 명시하고 있을 뿐이다. 현행 일차산품의 매매가 이들 협회에 의해 주도되고 있고 표준계약서에서 인 코텀즈의 적용을 배제하지 아니하는 한 일차산품의 연속매매에서 인코텀즈의 적용에는 한계가 있다. 따라서 국제상업회의소는 이들 협회에서 인코텀즈의 적용을 바라기 보다는 자체적으로 일차산품매매를 위한 표준계약모델을 개발하는 것이 필요할 것이다.
