Currently the Korea Correctional Service belongs to the Ministry of Justice. In spite of its huge scale of the organization, it is still managed as a dependent organization by the Ministry of Justice. In order to achieve the goal of corrections effectively, the personnel and the budget of the Korea Correctional Service will have to be managed independently from the Ministry of Justice. Furthermore, the policies of corrections should be established and implemented in the term of long period. Consequently the Department of Corrections is to be established as soon as possible in order to accomplish those goals, which would contribute to the protection of repeated crimes. This article summarizes and reviews the opinions which some professors had insisted so far regarding the establishment of the Department of Corrections. Also it puts together the proposals that had been suggested by some members of the National Assembly and their progress so far. Finally, the article asserts the necessity of the establishment of the Department of Corrections and suggests some methods to overcome problems with the ongoing process.

현재 교정본부는 법무부에 속해있으며, 그 조직의 방대함에도 불구하고 아직도 외청으로 독립되지 않은 상태로 운영되고 있다. 교정의 목적을 효과적으로 달성하기 위해서는 인사와 예산이 독 립되어야 하고 또한 정책이 장기적으로 수립되고 집행되어야 한 다. 이를 위해 교정청이 신설되어야 하고 독립적으로 운영됨으로 써 재범방지 기능도 더욱 효과적으로 수행될 것이다. 본고에서는 그간 교정청 독립에 관하여 학자들이 주장했던 견해를 정리하고, 또한 국회차원에서 지속적으로 입법 노력이 있었던 상황에 대하 여 그간의 경과를 설명하였다. 그리고 교정청 설치에 관한 필요 성에 대하여 그 사유를 나열하고 그에 대한 대책을 주장하였다.
