긴급수용 보상제도는 공권주체가 돌발상황에 빠르게 대응하고 이에 따른 물자자원 이 부족한 문제를 효과적으로 완화함으로서 공공이익을 수호하고 사적 권리를 보호하 며 법치정부건설을 촉진하는 데 있어서 중요한 의미를 가진다. 긴급수용 보상제도는 돌발사태에서 공권력의 합법적인 확장으로 인해 생긴 인권침해를 보상해주는 역할을 함으로서 공적 및 사적 권리의 균형을 유지하는데 중요한 역할을 한다. 현행 입법중 긴급수용보상과 관련된 규정들은 법률, 지방 법규, 지방 정부 규정 및 기타 행정 규범 문서에 분산적으로 규정되어 있다. 이와 같이 통일적인 입법의 결여로 돌발상태에 효과적으로 대응하기 어렵다는 문제가 제기되고 있다. 또한 현행 입법에서는 긴급수용 보상주체가 통일되지 않고, 긴급수용 보상기준이 명확하지 않으며, 긴급수용 보상절차 가 규범화되지 않고 효율이 낮으며, 피수용자가 보상을 받지 못하거나 혹은 보상이 불충분한 문제점도 제기되고 있다. 이에 대응하기 위하여 긴급수용 보상 관련 입법을 통일하고 국무원이 긴급수용보상에 관한 행정법규를 제정하며 관련 법제를 빠른 시일 내로 수정할 필요가 있다. 입법의 보완을 통하여 긴급수용 보상주체를 명확히 하고 긴급수용 보상주체를 현급이상으로 규정해야 하며, 긴급수용에 대한 보상기준을 명확 히 하고 적법하고 공정한 보상기준을 도입해야 한다. 그 외 보상의 효율성을 제고하기 위하여 긴급수용 보상절차를 직권에 따른 보상절차와 신청에 따른 보상절차로 분류하 여야 하며, 직권에 따른 보상절차를 일반절차로 규정할 필요가 있다고 본다.
