Japanese constitutional reinterpretation by the government interpretation is often regarded as a reflection of “constitutional consciousness of the Japanese.” The government’s attitude has been criticized for well complying with positive laws but being indifferent to what should be protected by law. If “what should be protected by law” at stake here refers to the “dignity of the individual,” which is at the core of modern constitutionalism, can one say that law exists in a Japanese society that tolerates such an attitude of the government? From this viewpoint, this paper tries to reconstitute the constitutional history of modern Japan with reference to Furukawa Atsushi, a constitutional scholar who has continuously explored the immaturity of Japanese civil society.

‘일본인의 헌법 의식’을 표현하는 것으로서 자주 제시되는 것이, 정부에 의한 ‘해석개헌’이라고 불리 는 현상이다. 이에 대한 비판은, 존재하는 법에 대해서는 잘 준수하는 한편으로 법으로 지켜져야 할 것 에는 둔감하다는 정부의 태도에 쏟아졌다. 여기서 희생당하는 ‘법으로 지켜져야 할 것’이 근대 입헌주 의의 중핵에 있는 ‘개인의 존엄’이라고 한다면, 이러한 정부의 태도를 용인하는 일본 사회에 과연 법은 존재한다고 할 수 있을까. 이러한 관점에서 본고는 일본 시민 사회의 미성숙이라는 문제의식을 줄곧 지닌 헌법학자 후루카와 아쓰시(古川純)를 실마리로 하여 일본 근대 헌법사의 재구성을 시도하였다.
