The Korean Corporate Restructuring Promotion Act, which has been the foundation of the workout system, is set to expire in October. In line with the revision of the law, this study examines the obstacles to the workout system for companies in financial distress, and what public policies are planned to support workout companies to complement the system. The reasons that hinder the activation of the workout system include, first, the difficulty in obtaining new funds essential for corporate management, second, problems with the system of creditors' claims to purchase bonds who oppose the workout plan, third, management difficulties due to the designation of companies with signs of insolvency, fourth, the administrative, legal, and financial burdens of the process, and finally, the lack of follow-up management. In response, Korea Asset Management Corporation will implement the "Corporate Turnaround Accompaniment Program" to closely support companies throughout the pre-workout phase. KAMCO will provide financial and non-financial support to 'Accompanying Certified Companies' selected for support, including loans for operating expenses, support for asset and liability due diligence, linkage to KAMCO's other support programs, management consulting support, dispatch of 'dedicated accompanying staff', acquisition of NPLs, and provision of payment guarantees for resumption of financial transactions. The program will be piloted this year, and once the effectiveness of the program is proven, it will be fully implemented from next year.

워크아웃 제도의 근간이 되어온 기업구조조정촉진법의 일몰 시한이 올해 10월로 다시 도래하게 된다. 이 법의 재입법에 발맞추어 재무적 곤 경에 처한 기업이 워크아웃제도를 통해 경영정상화를 추진하는 데에 있 어 제도적인 장애 요소는 어떤 것이 있으며, 제도의 보완을 위해 공공 정책적으로 어떠한 지원정책의 마련이 필요한지를 살펴보고자 한다. 워 크아웃제도의 활성화를 저해하는 원인으로 첫째, 기업경영에 필수적인 신규 자금을 공급받기가 쉽지 않고 둘째, 반대채권자의 채권매수청구권 제도에 문제점이 있으며 셋째, 부실징후기업 지정에 따르는 경영상의 애로와 넷째, 절차 진행에 수반되는 행정적, 법률적, 재무적 부담과 마지 막으로, 사후 관리의 미흡을 들 수 있다. 이에 대해 한국자산관리공사는 워크아웃의 모든 단계에 걸쳐 기업을 밀착 지원하는 ‘기업턴어라운드동 행프로그램’을 시행하고자 한다. 지원대상기업으로 선정된 ‘동행인증기 업’에게는 부실징후 단계부터 워크아웃 진행단계를 거쳐 절차 종결 이 후 단계까지 금융․비금융 지원을 시행한다. 즉, 운영 및 대환 자금의 대여, 자산부채 실사 비용의 지원, 캠코의 기존 지원 프로그램과의 연계, 경영 컨설팅의 지원, 전담 동행인의 파견, 반대매수청구 채권의 인수, 금 융거래 재개를 위한 지급보증의 제공 등이 그것이다. 금년 시범사업 기 간을 거쳐 제도의 효과성이 입증되면 내년부터 본격화할 계획이다.
