(Purpose) The purpose of this study is to critically examine the housing policies for agricultural migrant workers and to offer some policy suggestions. (Research methods) The research combined the literature analysis of the existing studies and laws and in-depth interviews with 12 key stakeholders(foreign workers, farmers, officials and activists). Drawing on the results, the study identified key issues and principles of housing policies for foreign workers. (Findings) The research showed that various policy efforts have been made so far by the central and local governments, legislators, and the national human rights agency. Nonetheless, the current housings for agricultural migrant workers are largely inadequate for residence, prone to sexual crimes and accidents, often unreasonably (pre)charged, while the commitment of employers and the government(s) is limited. (Conclusion and recommendations) Policy recommendations include placing greater responsibility on employers to provide accommodations for foreign workers, making it mandatory to satisfy enhanced housing standards when applying for an employment permit, expanding the supply of publicly owned/operated accommodations, and incorporating migrant workers into public housing schemes by amending related legislations.

(연구목적) 본 논문은 농업에 종사하는 외국인근로자를 중심으로 한국 외국인근로자 주거정책을 비판하고 발전 방향을 모색하는 것을 목적으로 한다. (연구방법) 본 연구는 기존 연구와 법령을 포함한 문헌자료 분석과 다양한 이해관계자(이주노동자, 농업인, 공무 원, 활동가) 12명과의 심층면접 방법을 결합하였다. (연구결과) 연구결과 중앙 및 지방정부, 국회, 인권위 차원에서 다양한 개선노력에도 불구하고 현재 농업분야 외 국인근로자 주거는 거주공간으로서 부적절하고, 성폭력과 안전사고에 취약하며, 불합리한 숙식비 공제가 이뤄지 고 있으며, 사용자와 국가의 책임 수준이 낮다고 평가할 수 있다. (결론 및 제언) 주거의 안전성, 독립성, 비용 적정성, 생할 편의성, 위치의 적절성 원칙을 토대로 다음과 같이 주 거정책 개선방안을 제안하였다. 첫째, 사용자의 외국인근로자 숙소 제공 의무를 강화하고 정부 지원을 위한 근거 규정을 마련해야 한다. 둘째, 주거의 안전성과 생활편의성 확보를 위해 고용허가를 위한 숙소 기준을 강화할 필 요가 있다. 셋째, 비용의 적절성 원칙에 부합하고, 안전성과 접근성(위치)을 담보하기 위해 정부와 지자체가 운영하는 공공형 기숙사 공급 확대를 제안한다. 넷째, 관련법 제･개정을 통해 외국인근로자 숙소 용도로 활용가능 하도록 공공임대주택 적용 범위를 확대할 필요가 있다.
