Recently, efforts have been made in various fields to create new added value based on the marine tourism industry, and one of the most attention-grabbing sales is ‘Amphibious Vehicle’. However, the system to support the development and commercialization of related industries using domestic amphibious vehicles remains at a low level compared to other developed countries. In particular, it was confirmed that the absence of related laws and systems is the biggest obstacle to commercialization, and that it is facing policy limitations that do not reflect social demands. In order to solve these problems, starting with reviewing domestic and overseas operation status, we reviewed ｢Act on Registration and Operation of Multimodal Transportation, Etc.(bill)｣, which was discussed in 2010, and various related laws and systems. In particular, this researcher, recognizing the lack of previous research conducted from the institutional point of view of amphibious vehicles, reviewed the maritime excursion ship business related matters directly related to the Korea Coast Guard before confirming the overall industry and system related to amphibious vehicles. It aims to present policy alternatives along with the developmental direction of related laws and systems, focusing on the enactment of the special law.

최근 들어 해양관광산업을 기반으로 새로운 부가가치 창출을 위한 각계의 노력이 이루어지고 있는 가운데 가장 주목받는 분양 중 하나가 바로 ‘수륙양용(水陸兩用)자 동차(Amphibious Vehicle)’이다. 하지만 국내 수륙양용차를 이용한 관련 산업의 발전 과 상용화를 뒷받침할 제도는 다른 선진국에 비해 낮은 수준에 머물고 있다. 특히 관련 법령과 제도의 부재는 상용화에 대한 가장 큰 걸림돌이 되고 있다. 이에 본 연 구자는 사회적 요구를 반영하지 못하는 정책적 한계에 마주하고 있음을 확인하였다. 이러한 문제를 해결하기 위해 국내·외 운용현황을 검토하는 것을 시작으로 2010년 입법 논의가 있었던 ｢복합형교통수단의 등록 및 운항 등에 관한 법률(안)｣과 여러 관련 법령 및 제도들을 검토해 보았다. 특히 본 연구자는 수륙양용차의 제도적 관점 에서 진행된 선행연구가 매우 부족함을 인식하고 수륙양용차 관련 산업과 제도 전반 을 확인하기보다 단계적 연구 진행을 위해 해양경찰청과 직접적인 연관성을 보이는 해상 유선사업 관련 사항들을 우선적으로 검토하고 관계 법령과 제도의 발전적 방향 과 함께 정책 대안 등을 특별법 제정 중심으로 제시하고자 한다.
