International commercial arbitration has long been the hallmark of international dispute resolution. However, with the increasing establishment of specialized courts dealing solely with commercial disputes the popularity of arbitration is being called into question. The phenomenon of international commercial courts is not completely new, but their number has significantly increased in recent times. For the efficient enforcement of judgments of the international commercial court, there are growing interests in blockchain and smart contract. Through the blockchain and smart contract, international commercial court has reached the possibility to automatically enforce its judgment with no need to rely on recognition. Some international commercial courts have already launched a new plan of blockchain-based system. This article analyzes and discusses a phenomenon of international commercial court, and its judgment enforcement model with the blockchain and smart contract.

국제상사분쟁이 발생한 경우 이를 해결하기 위한 수단은 여러 가지가 존재하지만, 현재 국제상사분쟁 당사자에게서 가장 널리 선택・활용되고 있는 것은 국제상사중재이다. 다만 국제상사중재에도 장점만이 존재하는 것은 아니며, 과도한 비용이나 중재인의 중립성 등의 측면에서 국제상사중재에 대한 비판이 제기되었고, 최근 그 대안으로 국제상사법원이 주목을 받고 있다. 국제상사법원은 여러 국가에서 최근 경쟁적으로 설립되고 있는데, 이는 국제상사분쟁 해결에 적합한 법원으로서의 지위를 획득함과 동시에 국제상사분쟁에서의 주도권을 획득하려는 시도로 보인다. 국제상사법원은 그 특성상 국제상사법원의 판결을 다른 국가에서 강제집행해야 하는 경우가 많은데, 효율적인 강제집행을 위해 다양한 강제집행방법을 마련하여 두고 있으나 보다 효율적이고 신속한 강제집행방법이 마련되어야 할 필요성 또한 꾸준히 제기되고 있다. 이에 대한 대안으로 최근 블록체인과 스마트계약을 활용한 판결의 강제집행 모델이 제시되고 있는데, 이러한 모델은 과거에 비해 비교할 수 없을 정도로 신속하고 효율적인 판결의 강제집행이 가능하다는 점을 그 강점으로 내세우고 있으며, 일부 국가는 선도적으로 이를 도입하려는 움직임을 보이고 있다. 이 글에서는 국제상사법원에 관한 개괄적인 내용을 우선 다루고, 국제상사법원의 판결에 대한 강제집행방법에 대해 살피고자 한다. 다음으로는 블록체인과 스마트계약을 활용한 판결의 강제집행 모델의 소개에 앞서, 해당 기술에 대해 간략하게 살펴보고자 한다. 마지막으로는 블록체인과 스마트계약을 활용한 강제집행 모델의 모습에 대해 보고, 해당 모델의 장단점에 대해서도 간략하게 살펴보고자 한다.
