A Study on Policy Measures for Effective Aviation Safety

The development of international aviation law has significantly reduced major illegal acts targeting aircraft, but the number of in-flight incidents that threaten safe operation continues to increase. In Korea, the number of in-flight incidents is increasing due to its weaker penalty system compared to other countries. Even though, in reality, the rules of punishment for illegal acts in aircraft are being strengthened, the cases of actual punishment are lacking. Besides, the suspects are, even if the punishment is enforced, subject to a probation or a fine. Thus, its actual effectiveness has been questioned. For the occurrence of in-flight disturbances can interfere with the operation of the aircraft, investigative agencies and courts need to view the activities as a critical crime considering the peculiarity of in-flight context, and the strict legal application is highly required. Other Major countries, to reduce the number of aviation crime, clarified the crime provisions, raised the punishment level, and are enforcing strong penalties, and these turned out to be effective. Therefore, it is time for Korea as well to reconsider whether its punishment system for in-flight crimes which violate the Aviation Security Law is not too weak
