Youth entrepreneurship support policies are characterized by their interdisciplinary nature as they are related to jobs and overall welfare policies. Korea has been implementing various youth policies in the context of supporting young people, and support and interest in youth entrepreneurship is also on the rise. In line with this trend, this study examines how the youth entrepreneurship system functions in terms of the legal system. Specifically, we examined how local governments are implementing specific youth policies through their youth entrepreneurship policies by looking at the contents of local ordinances in addition to the central government's laws. In terms of the legal system, we found that Korea's youth policy is centered on the Youth Basic Law, but there is no detailed legislation on youth entrepreneurship. When we examined the enactment and operation of ordinances, we found that each metropolitan local government operates ordinances related to youth entrepreneurship, but we could not find any ordinances that reflect the characteristics of each region. When considering youth policy and youth entrepreneurship as a policy for local governments and balanced regional development, it is necessary to specifically consider the realistic needs of young people in the content of the ordinance.

청년 창업지원정책은 일자리 및 전반적인 복지정책과 연관되어 있다는 점에서 광범위한 분야를 아우르는 특징을 가진다. 우리나라는 청년에 대한 지원 맥락에 서 다양한 청년 정책을 펼쳐왔고 청년 창업에 대한 지원과 관심도 상승하고 있 는 추세이다. 본 연구는 이러한 흐름에 발맞추어 청년 창업 제도가 법제도 측면 에서 어떻게 기능하고 있는지 살펴보았다. 구체적으로는 중앙정부의 법률과 더 불어 광역지방자치단체의 조례 내용 분석을 통해 각 지방자치단체가 어느 정도 수준으로 청년 창업 정책을 구현하고 있는지 검토하였다. 법제도 측면에서 청년 창업에 대해 살펴본 결과 우리나라는 청년기본법 중심으로 청년 정책을 운영하 고 있지만, 청년 창업에 특화된 세부적인 법률안을 마련하고 있지는 않은 상태 이다. 조례 제정 및 운영 실태를 살펴본 결과 각 광역지방자치단체는 청년 창업 과 관련한 조례를 운영하고 있긴 하지만 각 지방의 특색을 반영한 조례안은 살 펴볼 수 없었다. 향후 지방자치 및 지방균형발전 정책으로서 청년 창업을 고려 할 때 조례 내용에 청년층의 현실적인 요구가 반영되어야 할 시점이라고 할 수 있다.
